I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />I <br /> I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br /> I~ROPOSED <br /> <br />I~INDINGS OF <br /> <br />1) That the applicant has applied for a conditional use permit to construct <br />a building and greenhouse and operate a garden market. <br /> <br />2) That the applicant appeared before the Planning and Zoning Commission <br />for a public hearing pursuant to the City zoning ordinance on October 4, <br />1983. That the public hearing was properly advertised and that the minutes <br />of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />3) That the standards for consideration are as follows: <br /> <br /> a) That the property is zoned B-1 and retail sales are a permitted <br />use but that the proposed structures do not comply with the City Code inasmuch <br />as they are temporary in nature. <br /> <br /> b) That the adjoining properties are zoned B-I, Business, and I-l, <br />Industrial, located on parcels of varying sizes. <br /> <br />c) That the closest similar use is within approximately ½ mile. <br /> <br />area <br /> <br />That there will be no adverse affect to the traffic flow in the <br /> <br /> e) That, properly maintained, the garden market should not adversely <br />affect other businesses in the area. <br /> <br />4) That the criteria for approval/disapproval are as follows: <br /> <br /> a) That the establishment's maintenance and operation will not be <br />detrimental to or endanger the public health, safety and general welfare <br />and is not contrary to established standards, regulations or ordinances of <br />other governmental agencies. <br /> <br /> b) That the structure and site improvements, as indicated as a part <br />of the applicant's request, are so designed and constructed that they will <br />not be unsightly, undesirable or obnoxious in appearance and that it will <br />not hinder the orderly and harmonious development of the City and the use <br />of the district wherein proposed. <br /> <br /> c) That the use will not be substantially injurious to the permitted <br />uses nor unduly restrict the enjoyment of other property in the immediate <br />vicinity nor substantially diminish and impair property values within the <br />area. <br /> <br /> d) That the establishment of the use will .not impede the orderly and <br />normal development and improvement of the surrounding property for uses <br />permitted in the zoning district. <br /> <br /> e) That adequate water supply and sewage disposal facilities are provided <br />and in accordance with applicable standards. <br /> <br /> f) That adequate access roads, on-site parking, on-site loading and <br />unloading berths and drainage have been or will be provided. <br /> <br /> <br />
