equipment or fixtures where they will interfere with any existing gas, electric, <br /> telephone, water, sewer or other utility facilities or with any existing installations of <br /> the City, or obstruct or hinder in any manner the various existing utilities serving <br /> the residents of the City. To the extent consistent with the City Code, City <br /> policies, procedures, rules and regulations, System cable and facilities may be <br /> constructed overhead where poles exist and electric or telephone lines or both are <br /> now overhead. However, in no case may the Grantee install poles in areas of the City <br /> where underground facilities are generally used by the utilities already operating. If <br /> the City, at a future date, requires all electric and telephone lines to be placed <br /> underground in all or part of the City, the Grantee shall, within a reasonable time, <br /> similarly move its cables and lines, at no expense to the City, and shall not seek <br /> damages from the City for such compliance. <br /> 3.5 Installation of Facilities. <br /> 3.5.1 No poles, towers, conduits, amplifier boxes, pedestal mounted terminal boxes, <br /> similar structures,or other wire-holding structures shall be erected or installed by the <br /> Grantee without obtaining any required permit or other authorization from the City. <br /> 3.5.2 No placement of any pole or wire holding structure of the Grantee is to be <br /> considered a vested fee interest in the Rights-of-Way or in City property. <br /> Whenever feasible, all transmission and distribution structures, lines, wires, <br /> cables, equipment and poles or other fixtures erected by the Grantee within the City <br /> are to be so located and installed as to cause minimum interference with the rights <br /> and convenience of property owners. <br /> 3.6 Safety Requirements. <br /> 3.6.1 All applicable safety practices required by law shall be used during Grantee's <br /> construction, maintenance and repair of the System. The Grantee agrees, at all <br /> times, to employ ordinary and reasonable care and to install and maintain in use <br /> commonly accepted methods and devices for preventing failures and accidents that <br /> are likely to cause damage or injuries to the public or to property. All structures <br /> and all lines, equipment and connections in the Rights-of-Way shall at all times be <br /> kept and maintained in a safe condition, consistent with applicable safety codes. <br /> 3.6.2 The Grantee's construction, operation or maintenance of the System shall be <br /> conducted in such a manner as not to interfere with City communications <br /> technologies related to the health, safety and welfare of City residents. <br /> 3.6.3 The Grantee shall install and maintain such devices as will apprise or warn <br /> Persons using the Rights-of-Way of the existence of work being performed on the <br /> System in Rights-of-Way. <br /> 3.6.4 The Grantee, or its Affiliate, shall be a member of the One Call Notification System <br /> (otherwise known as "Gopher State One Call") or its successor, and shall field mark <br /> the locations of its underground facilities upon request.
