Franchise, the Grantee shall identify the location of its facilities for the City at no <br /> charge to the City. <br /> 3.7 Removal of Facilities at Expiration of Franchise. <br /> At the expiration of the term for which this Franchise is granted, or upon the expiration of any <br /> renewal or extension period which may be granted, the City shall have the right to require <br /> the Grantee, at the Grantee's sole expense: (i) to remove all portions of the System System <br /> used exclusively for the provision of Cable Service from all Rights-of-Way within the City; <br /> and (ii)to restore affected sites to their original condition. Should the Grantee fail, refuse or <br /> neglect to comply with the City's directive, any portions of the System used exclusively for <br /> the provision of Cable Service may at the option of the City become the sole property of the <br /> City, at no expense to the City,or be removed, altered or relocated by the City at the cost of <br /> the Grantee. The City shall not be liable to the Grantee for damages resulting from such <br /> removal,alteration or relocation. <br /> SECTION 4. <br /> DESIGN PROVISIONS <br /> 4.1 System Facilities and Equipment. <br /> 4.1.1 The System generally shall have at least the following characteristics: <br /> 4.1.1.1 a modern design when built, utilizing an architecture that will <br /> permit additional improvements necessary for high-quality and <br /> reliable service throughout the Franchise term, and the capability to <br /> operate continuously on a twenty-four hour a day basis without severe <br /> material degradation during operating conditions typical to the <br /> Minneapolis/St. Paul metropolitan area; <br /> 4.1.1.2 Grantee shall maintain standby power generators capable of <br /> powering all headend equipment for at least twenty-four (24) <br /> hours. The back-up power supplies serving the System shall be <br /> capable of providing power to the System for not less than three (3) <br /> hours per occurrence measured on an annual basis according to <br /> manufacturer specifications in the event of an electrical outage. <br /> The Grantee shall maintain sufficient portable generators to be <br /> deployed in the event that the duration of a power disruption is <br /> expected to exceed three(3)hours; <br /> 4.1.1.3 facilities of good and durable quality, generally used in <br /> high-quality,reliable systems of similar design; <br /> 4.1.1.4 a System that conforms to or exceeds all applicable FCC technical <br /> performance standards, as amended from time to time, which <br /> standards are incorporated herein by reference, and any other <br /> applicable technical performance standards.
