4.1.1.13 facilities and equipment capable of operating within the <br /> temperature ranges typical to the climate over the calendar year; <br /> 4.1.1.14 the System shall be so constructed and operated that there is no <br /> perceptible deterioration in the quality of Public, Educational or <br /> Governmental Access Channel signals after delivery of such <br /> signals to the first interface point with Grantee's headend or the <br /> subscriber network, whichever is applicable, as compared with the <br /> quality of any other channel on the System. As used in this <br /> paragraph, "deterioration" refers to delivery that is within the control <br /> of the Grantee; and <br /> 4.1.2 The Grantee is authorized to operate the System within the territorial limits of the <br /> City as of the Effective Date of this Franchise. <br /> 4.1.3 The System shall provide sufficient capacity for interactive services at all times and <br /> have capacity materially equivalent to at least 870 MHz for all active and passive <br /> components. <br /> 4.1.4 The System shall initially have a minimum channel capacity to provide at <br /> least 78 channels downstream to all Subscribers, plus additional capacity for <br /> other services. <br /> 4.1.5 The System shall be designed and constructed in order to allow distribution of <br /> PEG Channels as provided in this Franchise. <br /> 4.1.6 All power supplies for the System shall be equipped with standby <br /> power capability in accordance with this Section 4.1, and shall use status <br /> monitoring equipment at all power supply locations. <br /> 4.1.7 Emergency Alert System. The Grantee shall install and thereafter maintain an <br /> Emergency Alert System ("EAS") fully compliant with local, state and <br /> federal EAS requirements. This EAS shall at all times be operated in <br /> compliance with FCC regulations. The System shall be capable of allowing <br /> authorized officials to override the audio and video on all channels on the <br /> System that may be lawfully overridden. <br /> 4.1.8 The Grantee shall not assert or otherwise raise any claim before a court of <br /> competent jurisdiction or any administrative agency alleging that, as of the <br /> Effective Date of this Franchise, the minimum System design and performance <br /> requirements set forth in this Franchise are unenforceable under or <br /> inconsistent with then current applicable laws or regulations, or any orders or <br /> decisions of the FCC. <br /> 4.2 [Intentionally deleted.] <br /> 4.3 System Construction Timetable. <br /> 17 <br /> 489232v1 RJV QU210.6 <br />
