The Commission shall have the right to rename, <br /> reprogram or otherwise change the use of these channels at any time, in its sole <br /> discretion, provided such use is Noncommercial and public, educational, <br /> governmental or religious in nature. Nothing herein shall diminish any rights <br /> of the Commission to secure additional PEG channels pursuant to Minn. Stat. <br /> § 238.084, which is expressly incorporated herein by reference. <br /> 6.1.3 Upon designating the location (i.e. channel number) of the PEG channels, the <br /> channels shall not be relocated without the consent of the Commission. Grantee <br /> shall make reasonable efforts to minimize relocations of the PEG channels. <br /> Grantee must request any channel relocation at least three (3) months prior to <br /> seeking to implement the channel relocation. Grantee shall reimburse the City, the <br /> Commission and/or PEG entity for any reasonable costs incurred for: (i) <br /> purchasing or modifying equipment,business cards, and signage; (ii) any marketing <br /> and notice of the channel change that the Commission, the City and/or PEG entity <br /> reasonably determines is necessary; (iii) logo changes; and (iv) promoting, <br /> marketing and advertising the channel location of the affected PEG channel(s) <br /> during the twelve-month period preceding the effective date of the channel change. <br /> Alternatively, the Grantee may choose to supply necessary equipment itself, <br /> provided such equipment is satisfactory to the City,the Commission or PEG entity. <br /> 6.1.4 Grantee shall make all PEG channels available in standard definition (SD), <br /> digital format, and in high definition (HD) provided that the signal received from <br /> the Commission, City or PEG entity by the-Grantee is in HD, and provided that <br /> the Grantee shall not be required to provide the PEG channels at a resolution <br /> higher than the highest resolution used in connection with the Grantee's delivery <br /> of other channels. Grantee may implement HD carriage of the PEG channels in <br /> any manner (including selection of compression, utilization of IP, amount of <br /> system capacity or bandwidth, and other processing characteristics)that produces <br /> a signal as accessible, functional, useable and of a quality comparable (meaning <br /> indistinguishable to the viewer) to broadcast HD channels carried on the cable <br /> system. The Commission acknowledges that HD programming may require the <br /> viewer to have special viewer equipment (such as an HDTV and an HD-capable <br /> digital device/receiver), but any subscriber who can view an HD signal delivered <br /> via the cable system at a receiver shall also be able to view the HD PEG channel <br /> at that receiver, without additional charges or equipment. <br /> All of the Access Channels will be made available through a multi-channel <br /> display (i.e. a picture in picture feed) on a single TV screen called a"mosaic" (the <br /> "Quad Cities Mosaic"), where a cable subscriber can access via an interactive <br /> video menu one of any of the seven (7) Access Channels. The Quad Cities <br /> Mosaic will be located on Channel 40. The seven (7) Access Channels will be <br /> located at Channels 8440-8445 and 8049 (SD), and 8940-8945 and 8549 (HD). <br /> The Quad Cities Mosaic will contain only Access Channels authorized by the <br /> Commission, provided that the Commission may add to its Mosaic channels <br /> originated by other franchising authorities with consent of such originator if <br /> programming on such channel(s) is of public interest within the Quad Cities <br /> Franchise Area.
