City of Ramsey' AGREEMENT TO GUARANTEE COMPLIANCE WITH DEVELOPMEN2~ COND I TIONS ESTABLISHED BY THE CITY OF RAMSEY Between Charles Lundgren and Lloyd Bearl, dba Minnesota Utilities Contracting Inc., herein after called Applicant and the City of Ramsey. INTENT AND PURPOSE This agreement is to assure that the conditions of approval established by the City of Ramsey for all commercial and industrial developments are understood between the Applicant and the City of Ramsey, and that the Applicant complies with said conditions fully within the time frames estab- lished by this agreement. This agreement acknowledges that the Applicant has made the proper application, for the approval granted by this agreement and has met all other conditions established by the Planning & Zoning Commission and the City Council. Legal Description of Property: Tract B, Regi.stered Land Survey ]/30, Ramsey, Minnesota Property Address: 6100 Industry Avenue, Ramsey, Minnesota 55303 Zoning Classification: I-l/Industrial Approved Use of Property: I-l/Industrial CONDITIONS OF AGREEMENT 1. Applicant shall submit to the City of Ramsey eleven (11) copies of the final site plan which conform to all City of Ramsey conditions of approval. 2. Applicant shall complete and occupy his building or facility and all landscaping and other site work as per the stamped approved final site plan no later than September 30, 1980. 3. Appli'cant shall deposit with the City of Rams'ey, a cashier's check, irrevocable letter of credit, performance bond, or other suitable security acceptable to the City of Ramsey in the amount of 150 percent (150%) of the cost of completing all landscaping improvements, outside lighting, marking of fire lane to insure access to the building for fire fighting equipment. In addition the following items shall also be covered by the bond: a) Construction of the drainage 'pond and area with a t to 1 slope maximum. b) Construction of the percolation base and erosion control measures.
