4. Applicant acknowledges that failure to complete the improvements ' described in Paragraph //3 above by September 30, 1980, shall result in forfeiture of the financial guarantees provided to the City of Ramsey and the City shall then be authorized t'o complete the improvements from the escrow funds and the Applicant by execution of this agreement hereby permits the City or its agent to come on his property to complete the improvements. 5. The bond shall be made out in such a manner that it shall cover the landscape plantings for a period of two (2) growing seasons. 6. The amount of the bond or escrow to complete the construction and installation of the improvements is $ / 7. Applicant shall notify the City of Ramsey at least 72 hours in advance of the date Applicant is ready for final inspection of his site, and of his request for release of the financial guarantees provided to the City of Ramsey in Para- graph //3. 7. Construction of the building shall be as shown on the building design plan submitted and as approved by the City Building Official, The approved building design plan is attached hereto as Exhibit "B". 8. If Applicant does not commence construction of his project, including physical facilities, on or before , the City Council approval shall be considered null and void for the entire project unless an extension is granted by the City Council. APPROVAL Upon full compliance of the "Conditions of Agreement" above described, the City of Ramsey shall give Applicant full and final approval for the project and all escrow, heretofore deposited and unused shall be returned to the Applicant. SUMMARY: This Agreement shall be binding on the heirs, successors and assigns of the Applicant. APPLICANT: Minnesota Utilities Contracting Inc.
