ADM ~' ADM1NISTR/\I'IVE PROORES FOR EQB REVIEW OF PLAN FIULATION AMENJ,'II:NFS AND DISCREI'IONARY ACl'IONS TAKEN BY COMMU TIES OPERATING UNDER EQI] APPROVED CRITICAL AREA PLANS AND REGULATIONS I. Definitions: "Amendment" means any formal action by a public agency or local unit of government incl~ding its boards and commissions which in effect modifies its adopted plans, policies and regulati, ons for the lands and waters within the Mississippi River Corridor Critical Area. Amend- ments would include, among others, text changes and rezonings. Capitol Improvement Program changes ~;~ill not be considered a plan amendment, but will be reviewed with the plans and regulations every two years. 2. "EQB" means the Environmental Quality Board. "Discretionary Actions" means any permit application or procedural approval which result in the change, amendment or modification of a communities Critical Area Plan or any of its zoning, subdivision or other regulatory devices as it affects development of parti- cular projects. Discretionary actions shall include, among others, variances and conditional or compatible use permits. II. ACTIONS REQUIRING REVIEW Local units of government and regional and state agencies having jurisdiction within the Mississippi River CoFridor Critical AWea shall notify the EQB of the following plan or regulation amendments and discretionary actions prior to takin.g final action to approve or deny: All proposed changes to the text and maps of Critical Area Plans and regulations, excluding capitol~'m~,rovemen~ programs. 2. All compatible or conditional use permits. 3. Any rezoning involving: ao A change in the allowed general use of the property; a change from open, conservation, or disignated parkland to any other zone, a change in the lot size or density standard in the Rural Open Space District, a change, from residential to commerical or industrial, or a change from commerical to industrial. bo A change in the permitted height of structures, including but not limited to a rezoning from single family with a 35 ft. height limit to a high rise residential zoning.
