In the absence of a public sewer, be disposed of at a site approved by <br /> <br /> the Department. <br /> <br /> 3. Shall not be discharged into any lake, watercourse, drainage system, or <br /> onto land draining to a lake, watercourse, or drainage system, or within <br /> the limits of the scenic riyer distr~ct, <br /> <br /> E. Agricultural waste disposal operations in shoreland areas must conform to the <br /> standards, criteria, rules and regulations of the Minnesota Pollution Control <br /> Agency. <br /> <br /> NONCONFORMING AND SUBSTANDARD USES AND SETBACKS , <br /> Nonconforming Uses. Uses which are prohibited by this ordinance but which were- <br /> in existence prior to the effective date of this ordinance shall De nonconforming <br /> uses. Such use~ shall not be intensified, enlarged, or expanded beyond the permitter <br /> or delineated b6undaries of the use or activity as stipulated in most current per- <br /> mit issued prior to the adoption of this.ordinance. <br /> <br />Nonconforming Sanitary Sys~emp.. All sanitary facilities inconsistent with the <br />performance standards'of other applicable local ordinances and the minimum ~tandards <br />set forth in this ordinance shall be brqught into conformity or discontinued with- <br />in five (5} years of the date of enactment of this or other applicable ordinances. <br />Substandard Uses. All uses in existence prior to the effective date of enac%3nent -.. <br />or amendment of this ordinance which are permitted uses within the newly established <br />land u~e district, but do not meet the minimum lot area, setbacks or other dimen- <br />sional requirements of this ordin~]ce are substandard uses. All-su]~Standard uses, <br />except for substandard signs, shall be allowed to continue subject to the followl.ng <br />conditions and exceptions: <br /> <br />A. Any structural alteration or a~'dition to a. substandard use which will increase <br /> thm substandard dimensions shall not be allowed.- <br /> <br />B. Substandard s. igns shall be gradi~ally eliminated over a period of t'ime not to <br /> exceed five (5} years from the date Of enactment of this ordinance. <br /> <br />Nonconforming Setback. Where a set'back pattern from the ordinary ~igh watermark <br />~as already been established on bot~ sides of a proposed buildin~ site', the set-- <br />back of the proposed structure may be allowed to conform to that pattern. <br />ADMINISTRATION <br /> <br />Board of Adjustment. The provisions of Section 7.01 of the Anoka County S horeland <br />Ordinance shall appl~[ <br /> <br />Variance. The grant of a variance requires the presence of th~ follow~ng condi- <br />tions: <br /> <br />A. The strict enforcement of the land use controls will result in unnecessar~ <br /> hardship. <br /> <br />B. Grant'.~ng of the variance is not contrary to the purpose and intent of the'toning <br /> provisions herein established by these standards and criteria, and is consis- <br /> tent with NR 2700. <br /> <br /> There are exceptional circumstances unique to the subject property which were <br /> not created by th~'landowners. <br /> qranti.~g of the'variance will not allow any use which is neither a Permitted or <br /> Conditional use'in the land use district in which the subject property is <br /> located. <br /> <br /> Grant'.~ng of the' variance will not al~r tha essential character of the localit~ <br /> as e~tahl~sh~a by t~u~ maqagement plan, ~R 270~. <br /> <br />Ce <br /> <br />De <br /> <br /> <br />
