09/22/16 REVISOR CKM/IL AR4240 <br />10.1 Subp. 59. Public waters. "Public waters" has the meaning given under Minnesota <br />10.2 Statutes, section 103G.005. <br />10.3 Subp. 60. Readily visible. "Readily visible" means land and development that are <br />10.4 easily seen from the ordinary high water level of the opposite shore during summer months. <br />10.5 Subp. 61. Resource agency. "Resource agency" means a federal, state, regional, <br />10.6 or local agency that engages in environmental, natural, or cultural resource protection or <br />10.7 restoration activities, including planning, implementation, and monitoring. <br />10.8 Subp. 62. Retaining wall. "Retaining wall" means a vertical or nearly vertical <br />10.9 structure constructed of mortar and rubble masonry, rock, or stone regardless of size, <br />10.1 o vertical timber pilings, horizontal timber planks with piling supports, sheet pilings, poured <br />10.11 concrete, concrete blocks, or other durable material. <br />10.12 Subp. 63. Riprap. "Riprap" means coarse stones, boulders, cobbles, broken rock or <br />10.13 concrete, or brick materials placed or constructed to armor shorelines, streambeds, bridge <br />10.14 abutments, pilings, and other shoreline structures against scour or water or ice erosion. <br />10.15 Subp. 64. River corridor boundary. "River corridor boundary" means the boundary <br />10.16 approved and adopted by the Metropolitan Council under Minnesota Statutes, section <br />10.17 116G.06, as approved and adopted by the legislature in Minnesota Statutes, section <br />10.18 116G.15, and as legally described in the State Register, volume 3, pages 1681 to 1691. <br />10.19 Subp. 65. River -dependent use. "River -dependent use" means the use of land <br />10.20 for commercial, industrial, or utility purposes, where access to and use of a public <br />10.21 water feature is an integral part of the normal conduct of business and where the use is <br />10.22 dependent on shoreline facilities. <br />10.23 Subp. 66. Selective vegetation removal. "Selective vegetation removal" means <br />10.24 removal of isolated individual trees or shrubs that are not in a contiguous patch, strip, row, <br />10.25 or block and that does not substantially reduce the tree canopy or understory cover. <br />6106.0050 10 <br />
