09/22/16 REVISOR CKM/IL AR4240 <br />39.1 F. existing and new nonmetallic mining operations must submit land <br />39.2 reclamation plans to the local government compatible with the purposes of this chapter. <br />39.3 Subp. 6. River -dependent uses. River -dependent uses must comply with items A <br />39.4 to C. <br />39.5 A. Structures and parking areas, except shoreline facilities and private roads and <br />39.6 conveyances serving river -dependent uses as provided in part 6106.0180, must meet the <br />39.7 dimensional and performance standards in this chapter, must be designed so that they are not <br />39.8 readily visible, and must be screened by establishing and maintaining natural vegetation. <br />39.9 B. Shoreline facilities must comply with chapter 6115 and must: <br />39.10 <br />39.11 affected; and <br />(1) be designed in a compact fashion so as to minimize the shoreline area <br />39.12 (2) minimize the surface area of land occupied in relation to the number of <br />39.13 watercraft or barges to be served. <br />39.14 C. Dredging and placement of dredged material are subject to existing federal <br />39.15 and state permit requirements and agreements. <br />39.16 Subp. 7. Wireless communication facilities. Wireless communication facilities <br />39.17 require a conditional use permit or interim use permit issued by the local government. <br />39.18 In addition to the conditional use permit or interim use permit requirements under part <br />39.19 6106.0080, the following conditions apply: <br />39.20 A. the applicant must demonstrate that functional coverage cannot be provided <br />39.21 through co -location, a tower at a lower height, or a tower at a location outside the <br />39.22 Mississippi River Corridor Critical Area; <br />39.23 B. the tower must not be located in the bluff impact zone or shore impact <br />39.24 zone; and <br />39.25 C. placement of the tower must minimize impacts on public river corridor views. <br />6106.0110 39 <br />
