09/22/16 REVISOR CKM/IL AR4240 <br />38.1 Subp. 5. Nonmetallic mining. If allowed by the local government, nonmetallic <br />38.2 mining requires a conditional use permit or interim use permit issued by the local <br />38.3 government, subject to the following: <br />38.4 A. new nonmetallic mining is prohibited within the shore impact zone, bluff <br />38.5 impact zone, and within the required structure setback from the bluffline; <br />38.6 B. processing machinery must be located consistent with setback standards for <br />38.7 structures as provided in part 6106.0120; <br />38.8 C. only one barge loading area, which must be limited to the minimum size <br />38.9 practicable, is permitted for each mining operation; <br />38.10 D. new and, where practicable, existing nonmetallic mining operations must <br />38.11 not be readily visible and must be screened by establishing and maintaining natural <br />38.12 vegetation. The unscreened boundaries of nonmetallic mining areas are limited to only the <br />38.13 barge loading area; <br />38.14 E. a site management plan must be developed by the operator and approved <br />38.15 by the local government before new nonmetallic mining commences. Operations must <br />38.16 be consistent with the site plan throughout the duration of operations at the site. The site <br />38.17 management plan must: <br />38.18 (1) describe how the site will be developed over time with an emphasis on <br />38.19 minimizing environmental risk to public waters; <br />38.20 (2) explain where staged reclamation may occur at certain points during <br />38.21 the life of the site; <br />38.22 (3) address dust, noise, storm water management, possible pollutant <br />38.23 discharges, days and hours of operation, and duration of operation; and <br />38.24 (4) describe any anticipated vegetation and topographic alterations outside <br />38.25 the pit, and reclamation plans consistent with the stated end use for the land; and <br />6106.0110 38 <br />
