Taller buildings are allowed by conditional use permit, <br />41.2 as provided under item D; and <br />41.3 (6) CA-UC: height is determined by the local government's underlying <br />41.4 zoning requirements, provided tiering of structures away from the Mississippi River and <br />41.5 blufflines is given priority, with lower structure heights closer to the river and blufflines, <br />41.6 and structure design and placement minimize interference with public river corridor views. <br />41.7 B. For the purposes of this subpart, height is determined by applicable local <br />41.8 government zoning regulations, provided it is measured on the side of the structure facing <br />41.9 the Mississippi River. <br />41.10 C. The height requirements in item A do not apply to those structures and <br />41.11 facilities identified in part 6106.0180 as exempt from these requirements, but meeting the <br />41.12 setback requirements of subpart 3. <br />41.13 D. In addition to the conditional use permit requirements in part 6106.0080, <br />41.14 criteria for considering whether to grant a conditional use permit for buildings exceeding <br />41.15 the height limits in item A must include: <br />41.16 (1) assessment of the visual impact of the proposed building on public river <br />41.17 corridor views, including views from other communities; <br />41.18 (2) identification and application of techniques to minimize the perceived <br />41.19 bulk of the proposed building, such as: <br />41.20 (a) placing the long axis of the building perpendicular to the river; <br />41.21 (b) stepping back of portions of the facade; <br />41.22 (c) narrowing the profile of upper floors of the building; or <br />41.23 (d) increasing the setbacks of the building from the Mississippi River <br />41.24 or blufflines; <br />6106.0120 41 <br />
