Local governments must grant the permit, deny the permit, or grant the permit <br />53.2 with conditions necessary to achieve the purposes of this part, as provided under subpart 5. <br />53.3 Subp. 5. Permit conditions. In reviewing and approving permit applications, the <br />53.4 local government must ensure through permit conditions that the following performance <br />53.5 standards are met: <br />53.6 A. development is sited to minimize removal of or disturbance to natural <br />53.7 vegetation; <br />53.8 B. soil, slope stability, and hydrologic conditions are suitable for the proposed <br />53.9 work as determined by an a professional engineer or resource agency; <br />53.10 C. clearing is the minimum necessary and designed to blend with the natural <br />53.11 terrain and minimize visual impacts to public river corridor views; <br />53.12 D. any native plant communities removed are replaced with vegetation that <br />53.13 provides equivalent biological and ecological functions. If replaced, priorities for <br />53.14 restoration are stabilization of erodible soils, restoration or enhancement of shoreline <br />53.15 vegetation, and revegetation of bluffs or steep slopes visible from the river; <br />53.16 E. all other vegetation removed is restored with natural vegetation to the <br />53.17 greatest extent practicable. Priorities for replacement are the same as under item D; <br />53.18 F. any disturbance of highly erodible soils is replanted with deep-rooted <br />53.19 vegetation with a high stem density; <br />53.20 G. vegetation removal activities are conducted so as to expose the smallest <br />53.21 practical area of soil to erosion for the least possible time; and <br />53.22 H. other conditions as determined necessary by the local government to achieve <br />53.23 the purpose of this part are met. <br />53.24 Subp. 6.
