Reestablishment of natural vegetation is required: <br />54.2 (1) as a condition of permits under subpart 5, items D and E; <br />54.3 (2) upon failure to comply with this part; or <br />54.4 (3) as part of the planning process for subdivisions under part 6106.0170. <br />54.5 B. The vegetation restoration plan must: <br />54.6 (1) include vegetation that provides suitable habitat and effective soil <br />54.7 stability, runoff retention, and infiltration capability. Vegetation species, composition, <br />54.8 density, and diversity must be guided by nearby patches of native plant communities; <br />54.9 (2) be prepared by a qualified individual as defined by the local <br />54.10 government; and <br />54.11 (3) include a maintenance plan that includes management provisions for <br />54.12 controlling invasive species and replacement of plant loss for three years. <br />54.13 C. The local government must issue a certificate of compliance after <br />54.14 determining that the restoration requirements of item B have been satisfied. <br />54.15 D. Vegetation management and restoration activities must be guided by Native <br />54.16 Vegetation Establishment and Enhancement Guidelines, incorporated by reference under <br />54.17 part 6106.0090. <br />54.18 6106.0160 LAND ALTERATION AND STORM WATER MANAGEMENT <br />54.19 STANDARDS. <br />54.20 Subpart 1. Purpose. The purpose of this part is to establish standards that: <br />54.21 A. protect water quality from pollutant loadings of sediment, nutrients, bacteria, <br />54.22 and other contaminants; and <br />54.23 B. maintain stability of bluffs, shorelines, and other areas prone to erosion. <br />54.24 Subp. 2.
