to achieve a higher level of protection of the resources within the MRCCA consistent with other local <br />goals. This clarification and permission was sought by local governments and other stakeholders during <br />the rule development process. <br />Subpart 5. Duties of the commissioner. The duties of the commissioner (hereinafter referred to as the <br />DNR) set forth in proposed Minn. R. 6106.0060, subp. 5 are largely unchanged from current statute, <br />Minn. R. 4410.8100 — 4410.9910, and Executive Order 79-19. Those duties include: <br />• Consultation. Both this subpart and Minn. Stat. § 116G.15, subd. 2 (2015) require that the DNR <br />consult with the named agencies and others that have a significant role in the MRCCA to ensure <br />the corridor is managed in a manner consistent with the purposes of the statute. This subpart <br />also requires that the DNR play a special consultative role with those units of government that <br />manage land within the MRCCA to ensure that they administer public lands in a manner <br />consistent with the MRCCA program. <br />• Technical assistance and advice. Local governments requested that the DNR provide them with <br />technical assistance and advice in the development, administration, and enforcement of the <br />plans and ordinances necessary to implement the MRCCA program. This subpart reflects DNR's <br />commitment to provide that requested advice and assistance as an important mechanism to <br />foster coordination and cooperation between the DNR and local governments. <br />• Review and approval of local plans and ordinances. Finally, this subpart specifies that the DNR <br />will coordinate the preparation, submittal, review and approval of all local plans and ordinances <br />submitted by local governments as specified in Minn. Stat. § 116G.15, subd. 5(30 and (4) (2015). <br />This is an essential responsibility of the DNR under the current MRCCA program. <br />Subpart 6. Duties of Metropolitan Council. The duties of the Metropolitan Council remain largely <br />unchanged from statute and Executive Order 79-19. In addition to its responsibilities in the MRCCA <br />program administration, the Metropolitan Council is charged with the oversight of local government <br />comprehensive plans in the Metropolitan area to assure consistency with metropolitan system plans. <br />Minn. Stat. §473.175, subd. 1 (2015). The review process set out in proposed Minn. R. 6106.0060, subp. <br />6 is designed to ensure that the MRCCA review process outlined herein is incorporated into the <br />Metropolitan Council's planning process for efficient planning. The process is also designed to integrate <br />comments from the Metropolitan Council into the final plans and ordinances approved by the DNR. <br />Subpart 7. Duties of cities. The duties of cities too are substantially unchanged from statute and <br />Executive Order 79-19. This subpart continues these duties for the 25 cities in the MRCCA, including: <br />• preparing, amending, and adopting plans and ordinances that meet or exceed the minimum <br />standards of the MRCCA rules; <br />• submitting plans and ordinances to the Metropolitan Council for review and comment, and to <br />the DNR for review and approval; and <br />• informing the DNR about discretionary actions taken under an approved plan or ordinance so <br />that the DNR can provide technical assistance to the local government, comment on proposed <br />actions, and monitor compliance with the MRCCA rules. <br />36 <br />
