CASE #13: <br /> <br />What this will accomplish is to eliminate a lot of ill feel- <br />ing with people expanding their non conforming use business <br />which they are not supposed to be doing. <br /> <br />b) Establishing Administrative Procedure Regarding the City <br /> <br />Mining Ordinance: Inasmuch as the City adopted its mining <br />ordinance by reference from the Uniform Building Code, there <br />are certain administrative procedures that Council should <br />establish a policy in regards to what they want administered. <br />The following are submitted as requiring a need for a policy <br />decision: <br /> <br />1) Plan check fee - Do we use the fee as set up in the <br />Uniform Building Code. <br /> <br />2) Grading Permit Fee - Do we use the fee as set up <br />in the Uniform Building Code. <br /> <br />3) Does Council want to review all plans for excavation. <br />It would be nV recommendation that Council review all <br />plans before a permit is issued and require a signed <br />agreement between the City and the miner. <br /> <br />We should insist on the following things to be accomplished: <br /> <br />a) Fencing around mining area, <br />b) Landscaping area and planging of vegetation after <br /> mining operation is completed, <br />c) Gate on road to mining area to keep people from <br /> hauling trash into area, <br />d) Mining area should be allowed only where the roads <br /> serving it are of a nine (9) ton construction, and <br />e) We should have the miner post bond to cover restora- <br /> tion and street repair if damaged by miner. <br /> <br />Enclosure (D3-j) contains a copy of our present mining ordi- <br />nance which we just adopted by reference. <br /> <br />ORDINANCE ENFORCEMENT: <br /> <br />The Planning and Zoning Commission discussed the lack of ordi- <br />nance enforcement and they raised some very good points. As <br />they feel the City should have a strict enforcement of Code <br />not selective enforcement of the Code. <br /> <br />Consequently, we need Council policy on this matter and it <br />should be discussed so Council has a complete picture of the <br />whole thing. <br /> <br /> <br />
