- 2 - <br /> <br />SECTION 6. <br /> <br />(NOTIFICATION.) <br /> <br />Stipulates the notification procedure. The local authority noti~ <br />fies the county recorder, who files and records the restrictvie <br />covenant; th~ auditor and assessor, who will thereafter tax the <br />land according to the act; the Metropolitan Council, which will <br />maintain maps of certified and covenanted lands; and the county <br />soil and water conservation district which may prepare an advisory <br />statement on existing or potential conservation problems for the <br />preserve land. <br /> <br />SECTION 7. (COMMENCEMENT OF PRESERVE.) <br /> <br />States that the land actually becomes an agricultural preserve'30 <br />days from the date of application. <br /> <br />SECTION 8. (DURATION.) <br /> <br />Provides that the preserve continues indefinitely until either the <br />owner or the authority initiates an eight year expiration period. <br />The owner can initate expiration at any time. But the authority <br />must change the planning and zoning and decertify eligibility <br />before it can initiate expiration. There is no penalty upon <br />expiration. <br /> <br />SECTION 9. (EARLY TERMINATION.) <br /> <br />Provides for early termination if a public emergency requires it. <br />Such termination is determined and authorized only. by the governor. <br /> <br />SECTION'10. (AD VALOREM PROPERTY TAXES.) <br /> <br />Limits property taxes in two wa~s: first, land in agricultural <br />use is valued solely according to its agricultural use value; <br />second, a maximum rate of tax is set, based on 105 percent of the <br />statewide average for township gross mill rates. Any revenue <br />shortfall resulting from limiting the mill'rate is reimbursed by <br />the state. The maximum tax rate and state' reimbursement does not <br />apply to residential property, just land and farm buildings. <br /> <br />SECTION~ll. ~IMITATION ON CERTAIN PUBLIC PROJECTS.) <br /> <br />Prohibits public sanitary sewer and water .systems benefiting lands <br />or buildings in Ag. Preserves. <br /> <br />SECTION 12. (PROTECTION FOR NORMAL FARM PRACTICES.) <br /> <br />Limits local restrictive o~dinances that interfere with normal <br />farm practices. <br /> <br /> <br />
