- 3 - SECTION 13. (STATE AGENCIES TO BE SUPPORTIVE.) "It shall be the policy of all state agencies to encourage the .. maintenance of viable farming in agricultural preserves." This section goes on to direct the joint legislative committee on agricultural land preservation to undertake a study of state agen- cy rules which negatively affect long-term agricultural lands. The deadline for completion of the study is January 1, 1982. SECTION 14. (ANNEXATION PROCEEDINGS.) Preserve land within a township cannot be annexed.to a municipal- ity without a specific finding by the Minnesota Municipal Board that either 1) the expiration period has begun; or 2) the surviving unit of government would not be able to provide-normal governmental functions and services; or 3)-the preserve would be completely surrounded by the muncipality. ~ SECTION 15. (EMINENT DOMAIN ACTIONS.) Imposes a process for review of most land acquisitions proposed bye?-o any entity possessing eminent domain powers. Places them on notice that they must show that no reasonable alternative exists. Requires a public hearing in the vicinity of the preserve. Pro- cess of review is conducted by the Minnesota Environmental Quality Board. Up to a one-year suspension is possible if the acquisition would be contrary to the purposes of the act. SECTION 16. (CONSERVATION.) Presumes that good soil and water'conservation practices will be followed by all owners. Provides process for review and correc- tion if excessive erosion occurs. A fine of up to $1,000 is pos- sible for failure to correct erosion problems within one year of notice. - SECTION 17. (LAND USE.) Requires that land be used solely for farming. The location of any new'residential structures is determined by the local 1 per 40 .ordinance; but the maximum density for the~preserve cannot exceed one unit per 40 acres. SE3221 4.21.80
