- 3 - <br /> <br />SECTION 13. (STATE AGENCIES TO BE SUPPORTIVE.) <br /> <br />"It shall be the policy of all state agencies to encourage the .. <br />maintenance of viable farming in agricultural preserves." <br /> <br />This section goes on to direct the joint legislative committee on <br />agricultural land preservation to undertake a study of state agen- <br />cy rules which negatively affect long-term agricultural lands. <br />The deadline for completion of the study is January 1, 1982. <br /> <br />SECTION 14. (ANNEXATION PROCEEDINGS.) <br /> <br />Preserve land within a township cannot be annexed.to a municipal- <br />ity without a specific finding by the Minnesota Municipal Board <br />that either 1) the expiration period has begun; or 2) the <br />surviving unit of government would not be able to provide-normal <br />governmental functions and services; or 3)-the preserve would be <br />completely surrounded by the muncipality. ~ <br /> <br />SECTION 15. (EMINENT DOMAIN ACTIONS.) <br /> <br />Imposes a process for review of most land acquisitions proposed bye?-o <br />any entity possessing eminent domain powers. Places them on <br />notice that they must show that no reasonable alternative exists. <br />Requires a public hearing in the vicinity of the preserve. Pro- <br />cess of review is conducted by the Minnesota Environmental Quality <br />Board. Up to a one-year suspension is possible if the acquisition <br />would be contrary to the purposes of the act. <br /> <br />SECTION 16. (CONSERVATION.) <br /> <br />Presumes that good soil and water'conservation practices will be <br />followed by all owners. Provides process for review and correc- <br />tion if excessive erosion occurs. A fine of up to $1,000 is pos- <br />sible for failure to correct erosion problems within one year of <br />notice. - <br /> <br />SECTION 17. (LAND USE.) <br /> <br /> Requires that land be used solely for farming.
