007 <br /> <br />Councilman introduced th~ motion to adopt the following find- <br />ings of fact regarding Mr. John Tousley's request to build a'larger <br />accessory building than the ordinance allows: <br /> <br />1) That the applicant has properly applied for a Board of Adjustment <br />variance as required by City Ordinance to construct an accessory build- <br />ing larger than allowed by City Ordinance. <br /> <br />2) That the applicant appeared before the Board of Adjustment for a <br />public hearing pursuant to the City Zoning Ordinance on May 13, 1980. <br />That said public hearing was properly advertized and the minutes of <br />that public hearing are hereby incorporated by reference. <br /> <br />3) That no protests to the applicants request were received either in <br />writing or at the public hearing. <br /> <br />4) That a letter was received from a neighboring resident in favor of <br />granting the applicants request. <br /> <br />5) That the applicant has applied for a building permit for an accessory <br />building of 1,248 square feet while City Ordinance would allow an <br />accessory building of 624 square feet. <br /> <br />6) That there are no exceptional, unique or extraordinary circumstances <br />that apply to the property in question that do not apply generally to <br />other properties in the same zoning district. <br /> <br />7) That the Board of Adjustment has not, in the past, granted requests <br />that vary to this degree from the ordinance. ' <br /> <br />8) T~at such a variance is not n~cessary for the preservation of sub- <br />stantial property rights similar to those of other properties in the <br />smne general area as accessory buildings of this proposed size, are not <br />co,non to the general area. <br /> <br />9) That in view of the proposed location and size, this structure will <br />not blend harmoniously in 'this neighborhood. <br /> <br />The motion for the adoption of the foregoing findings of fact were duly <br />seconded by Councilman and upon vote being taken thereon, the <br />following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />whereupon said findings of fact were duly passed and adopted by the <br />Ramsey City Council this the 27th day of l~%y, 1980. <br /> <br />ATTEST: <br /> <br />Mayor <br /> <br />City Admini strator/Clerk <br /> <br /> <br />
