Mayor Gamec then explained the proposed new outlets to Highway #!0 .West
of Rivlyn and Front Street. %~ere was general opposition to this plan
voiced by Mrs. Graves, Roger Dickenson and Mr. Pratt all area residents.

· Councilman Cox said he was opposed to constructing new outlets to Highway
#10 and that the way to handle problems was to work out the problem with
Grosslein. Mayor Gamec said the completion of Grosslein's new building
should help alleviate the situation.

The Council concluded that there was no question that a problem exists,
that at least for now no new streets will be constructed and the Council-
and staff will attempt to work with Mr. Grosslein in solving the problem
in a reasonable fashion satisfactory to all.

Mr~ Steve Volmer was present and he said he understood the proposed find-
ings of fact but that he didn't agree with them and would like to present
additional information. He stated only four neighbors objected to his pro-
posed 624 square foot greenhouse. Mayor Oamec stated that the Council
viewed this size greenhouse as a commercial .activity. lat. Volmer seated
that his greenhouse is not a commercial activity; that they-grow plant§~.
for themselves; that last year his wife gave'only four plant parties; that
they try and sell only enough plants to pay for heat.Lug the greenhouse.
Mr. Volmer showed a sketch of the proposed greenhouse showing that 320
feet would be used for actual growing, the balance wo~uld be used for
storage and working space. .

The City Attorney stated that even if there would be no plant selling,
a conditional use permit would be needed 'since a greenhouse is not a per-
mitred use in a residential zone.

The Council recessed for 20 minutes.

Mr. Volmer made additional comments concerning the size greenhouse he
wanted. Councilman Cox said his concern was'preservation Df'the neighbor-
hood asthetics and commercial aspects of the proposed use.

Motion by Councilman Reimann and seconded by. Counci~ Cox to adopt the
findings of fact as presented:

The following finding of fact is hereby written concerning the
above request:

1) A greenhouse of 624 square feet is considered to be too large
to be used solely for a hobby. This size of greenhouse is con-
sidered to constitute what would be 6haracteristic of a commercial-
type use rather than a hobby use.

2) This business may be competing with commercial businesses, and
co~Dercial establishments in commercial areas, pay taxes as such.

3) The City Council is willing to consider allowing the Volmer's
to construct a greenhouse if it does not exceed 10' x 12'.

C/Febrma~/ 25, 1980
