10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />That the Subject Property is zoned R-1 Residential- Rural Reserve, and the surrounding <br />parcels are zoned R-1 Residential. <br /> <br />That the Subject Property is approximately 23.5 acres. <br /> <br />That the Subject Property is surrounded by lots that are similar in size. <br /> <br />That glass and mirror businesses operated within an accessory structure are not a <br />permitted use in the R-1 Residential District without the issuance of a Home Occupation <br />Permit. <br /> <br />That on December 16, 2003 the City Council adopted a Home Occupation Ordinance <br />allowing residents the ability to apply for a Home Occupation Permit to operate a <br />business within an accessory structure and employ non-resident employees as outlined in <br />the Home Occupation Ordinance. <br /> <br />That the Applicant's property is 23.5 acres in size and therefore eligible to apply for a <br />Home Occupation Permit to operate a business within an accessory structure and employ <br />at most three non-resident employees. <br /> <br />That the accessory structure is located on the Subject Property, which contains a principal <br />dwelling. <br /> <br />That the Applicant resides at and is the fee title owner of the location of the proposed <br />home occupation. <br /> <br />That the Applicant does not typically receive material truck deliveries and does not have <br />customers coming to the property, and therefore the use is not creating excessive <br />vehicular traffic to the Subject Property as defined in Subd. 4 Section E of the Home <br />Occupation ordinance. <br /> <br />That the Applicant's business hours are Monday - Friday 7:00am - 5:00pm. <br /> <br />That the proposed use will not adversely impact traffic in the area. <br /> <br />That the proposed use will be compatible with the residential neighborhood due to <br />density and lot size of the surrounding lots. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment, or <br />market value of any surrounding property. <br /> <br />That the proposed use will not be hazardous or disturbing to existing or future <br />neighboring uses. <br /> <br />RESOLUTION #04-06-160 <br /> Page 2 of 3 <br /> <br /> <br />
