The facility would also include customer and employee parking that is proposed to be <br />absent of bituminous pavement. The business would be accessed through an existing dirt <br />driveway off of 181 st Ave. (County Road #22). <br /> <br />The hours of operation proposed are 6:00am to 6:00pm. Mr. Barrett currently has three <br />(3) employees and would like to expand to as many as ten (10). Approximately 3 times <br />per week track, deliveries would occur on the subject property. <br /> <br />The Building Official will be conducting an inspection of the structure to verify building <br />code compliance for the type of use proposed. The Building Inspector has stated that at a <br />minimum the structure will need to have either a window or door every fifty' (50) linear <br />feet, will need to be insulated, provide a ventilation system, and have sanitation facilities <br />available on site. Staff will give a verbal report on the condition of the structure at the <br />Planning Commission meeting. <br /> <br />Mr. Menard has informed the City that he would like to continue operating his <br />commercial business from his homestead. To do so Mr. Menard must be able to screen <br />his vehicles and equipment to a degree of 75%, or park them indoors. He would not be <br />allowed to have any employees or clients come to his home. <br /> <br />A building permit was issued and an illegal business was established in a significantly <br />sized non-conforming building. Since 1990, it has been the City's policy to not accept <br />applications for businesses to be operated out of garages and accessory buildings in the <br />residential districts. However, the City Attorney has advised that in this case, the <br />conditional use permit would provide the City with the opportunity to establish some <br />parameters for what is occurring on the property. <br /> <br />The proposed site plan has been forwarded to Anoka County Highway Department for <br />their review and comment. Staff hopes-to give a verbal report .on Anoka County <br />Highway Department's findings and recommendations at the meeting. <br /> <br />Staff is recommending that Mr. Barrett's Custom Woodworking business have operating <br />hours between 7:00am and 7:00pm Monday - Saturday, instead of 6:00am - 6:00pm. <br />City Code regulates construction hours as 7:00am - 10:00pm Monday - Saturday. Staff <br />feels that in a residential area operating hours of the proposed woodworking business <br />should comply with those set for construction activities. Staff would also recommend <br />that the driveway, customer and employee parking area be paved and curbed. Also, no <br />additional uses should be allowed on the property and any expansion of the existing <br />building or change in use would require a new conditional use permit. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval contingent with restrictions placed on hours of <br />operation, number of employees, site improvements, and future expansions of buildings <br />and uses. <br /> <br /> <br />
