Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION/404-08-201 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0690 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE FLOOR AREA RATIO (F.A.R) FOR THE PROPOSED <br />GROCERY STORE IN THE TOWN CENTER ZONING DISTRICT, SUBDISTRICT TC- <br />2. <br /> <br /> WHEREAS, RAMDANCE, LLC, hereinafter referred to as "Applicant," has properly <br />applied for a variance from Section 9.20.25, Subd. 3.b, regarding Floor Area Ratio (F.A.R.) <br />requirements in the TC~2 Commercial Zoning District, on the property legally described as <br />follows: <br /> <br />Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject <br />Property) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on August 5, 2004, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Subject Property is zoned TC-2 Town Center Commercial and is approximately 9 <br /> acres in size. <br /> <br />3. That properties to the east, west, and north are zoned TC-2 Town Center Commercial. <br /> <br />4. That the Subject Property is bounded on the south by the Burlington Northern Santa Fe <br /> Railroad. <br /> <br />5. That section 9.20.25, Subd. 3.b, establishes a minimum F.A.R. of 0.50. <br /> <br />6. That the Applicant is requesting a variance from the F.A.R. requirement in order to construct <br /> a grocery store on the Subject Property that will have a F.A.R. of 0.24. <br /> <br />7. That the grocery store is proposed to be constructed on Lot 1, Block 1, Ramsey Town Center <br /> 3rd Addition. <br /> <br />8. That Lot 1, Block 1 Ramsey Town Center 3rd Addition is proposed to be 391,410 square feet <br /> in size. <br /> <br /> <br />
