9. That under the TC-2 Zoning District, the required F.A.R. would require 195,705 square feet <br /> of building to be located on Lot 1, Block 1, Ramsey Town Center 3rd Addition. <br /> <br />10. That the Applicant is proposing to construct 93,207 square feet of buildings on Lot 1, Block <br /> 1, Ramsey Town Center 3rd Addition. <br /> <br />11. That based on the F.A.R. requirement of 0.5, the Applicant is deficient 102,499 square feet of <br /> building. <br /> <br />12. That the intent of the TC-2 Commercial Zoning District is to accommodate large scale retail <br /> buildings. <br /> <br />13. That larger scale retail buildings in the TC-2 Commercial Zoning District require large areas <br /> dedicated to surface parking as no are no parking ramps proposed for this area of the Town <br /> Center. <br /> <br />14. That the Applicant has stated that the amount of parking shown as part of the development is <br /> the minimum amount needed to properly serve the retail buildings contained on Lot 1, Block <br /> 1, Ramsey Town Center 3ra Addition. <br /> <br />15. That the Applicant has stated the variance requested is the minimum variance needed to <br /> alleviate the hardship. <br /> <br />16. That on May 6, 2004 and on May 11, 2004, the Planning Commission and City Council <br /> approved the sketch plan for the grocery store, which plan showed the Subject Property laid <br /> out as presently contemplated. <br /> <br />17. That if granted, the variance will not permit a use that is prohibited in the TC-2 Commercial <br /> Zoning District. <br /> <br />18. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br /> property. <br /> <br />19. That if granted, the variance will not endanger the public safety. <br /> <br />20. That if granted, the variance will not unreasonably diminish property values in the <br /> neighborhood. <br /> <br />21. That if granted, the variance will not violate the intent of the Comprehensive Plan. <br /> <br />22.
