TO: Mayor and City Council

FROM:

City Administrator

Board of Adjustment Information

Enclosure (D4-a) Council minutes dated May 27, 1980
(D4-b) Council minutes dated June 10, 1980
(D4~c) Notice of public hearing for variance
(.D4-d) Initial drawings for self service gas pumps
(D4-e)- Section 170.018E of the City Code

CASE #1:

REQUEST FOR VARIANCE SELF SERVICE GAS PUMPS AND TANKS TO

STREET SETBACK REQUIREMENTS; CASE OF MOROZ, INC.:

Background Information: The following is submitted to assist
the Board of Adjustment in reviewing this case:

a) Enclosure (D4-a) contains Council minutes dated May 27,
1980. In the minutes the City Engineer states the pumps
would have to be 110 feet from centerline or 50 feet from
right-of-way of 167th Avenue N.W. which would mean the pumps
would be only 10 feet from his building.

b) Enclosure (D4-b) contains Council minutes dated June 10,
1980. At this the Council asked if he could live with a
90 foot setback. He (Moroz) stated he couldn't go the 90
feet setback.

c) Enclosure (.D4-c) contains the notice of public hearing
for variance, application for'variance, list of citizens
notified of public hearing.

d) Enclosure (D4-d) contains the initial drawings that
Council reviewed back at the May 27, 1980 meeting.

Com~aents: In the Council minutes of June 10, 1980, Council
asked what requirements were made of Bob Muller when he applied
for a permit to operate a self service station at his store
location.

It should be noted that there was no requirement made on him
about setbacks from 167th Avenue N.W., however, the City is
now paying more attention to things and if Bob Muller would
apply now, he would be faced with the same problem.
