I)AUL ~,,~1~,~ <br /> <br />May 16, 1980 <br /> <br />TO: Superintendents of Schools <br /> <br /> The governor's Office, the State Legislature and the Commissioner <br />of Education generally support the philosophy that students in the schools <br />of our State should have the opportunity to become informed about the <br />military as a possible career. Not only can the military be a lifetime <br />career, but the training which a student from our schools would receive <br />could prepare that student for a career as a civilian when the enlistment <br />period is completed. <br /> <br /> In 1978 the Minnesota Legislatttre added Subdivision 12 to the <br />Minnesota Statutes 123.36 which reads as follows: <br /> <br />"If the board provides access to persons or groups which make <br /> pupils aware of occupational or educational options, the board <br /> shall provide access on the same basis to official recruiting <br /> representatives of the military forces of the state or the United <br /> States for the purpose of informing students on educational and <br /> career opportunities available in the military." <br /> <br /> There are certain conditions under which educational information <br />about a student can be given out. This is governed under Section 438 of <br />the Federal General Education Provisions Act, as amended {added by Section <br />SiS of Public Law 93-380 and amended by Section 2 of Public Law 93-S68). <br />This act and the regulations provide that the names and addresses of students <br />along with certain other information are "directory information" and may be <br />released without prior consent of the parents or students under certain <br />conditions. <br /> <br />These conditions in the regulations are as follows: <br /> <br />Section 99.37 Conditions for disclosure of directory information <br /> <br />a. An educational agency or institution may disclose personally <br /> identifiable information from the education records of a <br /> student who is in attendance at the institution or .agency if <br /> that information has been designated as directory information <br /> {as defined in Section 99.3) under paragraph (c) of this <br /> section. <br /> <br />b. An educational agency or institution may disclose directory <br /> <br />AN EQUAL OPPORTUNITY EMPLOYER <br /> <br /> <br />
