DEVFi.(I?I,;LN} CONTRACT - BURR' OAK JNDUSTRIAL PARK <br /> <br />City will apply the deposit of 10% to the remainin§ costs of'the improve- <br />ments. The Developer agrees that if the assessments are assumed by a <br />purchaser, the amount of the assumed assessment will be included in the <br />computation of the 90% when a certificate of occupancy has been issued for <br />a structure on the property on which the assessments have been assumed. <br /> <br />After the street surfacing is installed, the Developer shall clear any <br />soil, earth or debris from the streets within the plat resulting from any <br />construction on the land within the plat by the Developer or its successors <br />or assigns. <br /> <br />10. <br /> <br />The Developer agrees that this Development Contract shall be binding upon <br />its successors and assigns. Breach of any of the terms of this Development <br />Contract by the Developer may-~onstitute grounds for denial of all building <br />permits within the plat. <br /> <br />ll. <br /> <br />The Developer agrees not to sell, rent, or otherwise cause to be occupied, <br />any building construction upon property within the plat until the City has <br />approved the construction of the improvements within the plat, unless the <br />City Manager has agreed in writing to waive this requirement. <br /> <br />12. <br /> <br />The Developer agrees to reimburse the City for all costs incurred by the <br />City in the defense or enforcement of this Contract, or any portion there- <br />of, including court costs and reasonable'engineering and attorney's fees. <br /> <br />13. <br /> <br />14. <br /> <br />If any Portion, section, subsection, sentence, clause, paragraph, or'phase <br />of this Contract is for any reason held to be invalid by a court of compe- <br />tent jurisdiction, such decision shall not affect or void any of the other <br />provisions of the Development Contract. <br /> <br />The term "Developer" as used herei~ refers to' Good Value Homes, Inc. <br />and Donald L.
