Members of the Board DATE: September 4, 1980 FROM : PHONE: (612) 296-6619 SU BJ ECT: RE__QUEST FROM THE ANOKA / CHAMP~.IN J RAMSEY CABLE COMMISSION FOR POSTPONEMENT OF ACTION ON THE PROPOSAL BY THE CITY OF ANDOVER FOR EXPANSION OF THE ANOKA / CHAMPLIN / RAMSEY CABLE SERVICE TERRITORY TO INCLUDE THE CORPORATE LIMITS OF AHDOVER On June 12, 1980, the Minnesota Cable Communications Board received a proposal from the City of Andover, a Minnesota municipality, for expansion of the Anoka/ Champlin/Ramsey Cable Service Territory to include the corporate limits of Andover. During its regular meeting on June 13, 1980, the Board acknowledged receipt of the proposal from the City of Andover and scheduled consideration of the proposal for its regular meeting on September 12, 1980. Mr. Thomas D. Creighton, legal consultant to the Anoka/Champlin/Ramsey Cable Commission, a joint powers cable communications commission created under Minnesota Statutes § 471.59, has submitted a request for postponement of Board action on the proposal from the City of Andover on behalf of the Commission. The Comfidssion adopted a formal resolution at its first organizational meeting on August 27, 1980 objecting to the proposed expansion of its cable service territory and requests that a postponement of Board action be granted as provided in Rule 4 MCAR 4.13q E, which state~, The board may, upon good cause shown, postpone action on a cable service territory proposal until its next regularly scheduled meeting. The Anoka/Champlin/Ramsey Cable Commission furthermore requests that the Board refer the Andover proposal back to the city council of the City of Andover for the purpose of designation of an initial cab]e service area consistent with the original cable service territory proposal for Anoka, Champlin and Ramsey. Staff recommends that the Board approve this request from the Anoka/Champlin/ Ramsey Cable Commission for postponement of action as provided in the cited rule for reasons given in Mr. Creighton's letter to the chairman of the Board dated September 3, 1980. In the event this request is granted, the Board would be scheduled to consider the proposal during its regular'meeting on Oct- ober 17, 1980. Staff furthermore recommends that the Board refer the proposal back to the city council of the City of Andover for the .purpose stated in Mr. Creighton's letter dated September 3, 1980, a copy of which is attached hereto. A proposed motion granting the Commission's request and referring the proposal back to the City of Andover is also attached hereto.
