following the hearing, decides that improvements are necessary~ <br />it may elect to completely reconstruct the street and assess <br />100% of the cost of such improvement against benefitting prop- <br />erty owners in the matter hereinbefore described. <br /> <br />5. As an alternate to 3 above, the City may resurface ("over- <br />lay") or seal coat the street in accordance with the recommend- <br />ation of the City Engineer any of these improvements shall be <br />assessed 100% to benefitting landowners. <br /> <br />6. Ail upgrading of non surfaced streets to Class V standards <br />shall be assessed 100% to the benefitted property owners. <br /> <br />7. Only routine maintenance and emergency maintenance on City <br />streets shall be paid for from the City's general fund. <br /> <br />c. Section 210.015 DEFINITIONS is hereby amended of the following: <br /> <br /> 4. The "mnit area" for assessment purposes shall be the average <br /> unit area of the subdivided parcels lying within the area of <br /> benefit. Large units which may be divided into two (2) or more <br /> average units shall be assessed accordingly. Park areas shall <br /> be excluded from assessments. For corner lots the unit area <br /> assessment shall be adjusted such that any corner lot abutting <br /> any assessable street improvement shall be assessed only once. <br /> In the event that only one street adjacent to a corner lot is <br /> improved, the corner lot shall be assessed at the time that the <br /> street which the driveway enters into is improved. However, in <br /> the event the driveway from a corner lot enters into a major <br /> thoroughfare or collector street which is improved by other <br />.than local ftunds, that lot shall be assessed for a one-half unit <br /> at the time the side street is improved. Notwithstanding the <br /> foregoing, if the driveway servingthe corner lot which enters <br /> the major thoroughfare or collector street was constructed after <br /> April 30, 1972 (the date of the City's first subdivision ordi- <br /> nance) and said driveway was constructed in violation of the <br /> City ordinance and Code regulating the placement of driveways <br /> and access onto thoroughfare and collector streets, said corner~ <br /> lot will be assessed as one full unit. <br /> <br />6. "Routine Maintenance" shall consist of maintaining streets <br />in their origina~ condition at the time of their acceptance by <br />the City. Seal coating and "overlays" shall not be construed <br />as routine maintenance. <br /> <br />SECTION 2.
