2) Map showing location of ponds. <br /> <br />3) Excerpt from City Code Section 170.014B paragraph 3 - <br /> Council should review this. <br /> <br />Comments: The above parties just want to clean out or deepen <br />existing ponds that are located on their property. The present <br />depth of these ponds is about two (2) feet at high water and after <br />they are cleaned out they will have a maximum depth of five feet. <br />However, this will be a gradual slope to reach that depth. ~y <br />question is does the City want to invoke its ordinance on this <br />issue. M~ interpretation of the ordinance would be that it <br />would apply to a man made pond. However, deepending these ponds <br />could be interpreted that these are a man made ponds. <br /> <br />If we are going to invoke our ordinance, I think we should have <br />an agreement drawn up, etc. <br /> <br />Council Action: Your action will be to authorize the City <br />Administrator or Mayor to sign the application-and let them <br />excavate out the ponds under DNR supervision. <br /> <br />Council may desire to have compliance with your ordinance. <br /> <br />CASE t/3: ~ SITE PLAN FOR RALPH'S COUNTRY ~EATS REQUEST FOR APPROVAL: <br /> <br /> /.."\~ The following documentation is hereby submitted for your review <br /> and action: <br /> <br />a) <br /> <br />Enclosure (D3-c) contains the Building Inspector's report <br />on this case~which he aotes all_the-deficiencies in their <br />plan. This is what the developer <br />wants in this case. <br /> <br />c) <br /> <br />Enclosure (D3-e) contains a proposed resolution and agree- <br />ment between Gilbert Menkveld and Norman D. Holm to plat <br />said properties. If we don't execute this agreement, we <br />could very well have a compromise of the City's subdivision <br />Code.
