10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Siie. The exact location of <br />the fire lanes on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING; The site plan indicates there will be no outside lighting on the Site. <br /> <br />BUILDING FACADE. The Permittee agrees to construct all building faces of <br />the same material as listed on the Building Elevations Plan prepared by RJT dated <br />August 2, 2004. <br /> <br />STORxMWATER MANAGEMENT FEE. The Stormwater Management Fee <br />shall be due at the closing of the sale of the Development Property to the <br />Permittee. <br /> <br />REQUIREMENTS FOR BUILDING PERxMIT. No building permit for the Site <br />will be issued until the Permittee has: a) signed and returned this Development <br />Permit; and b) provided the City with a copy of the LRRWMO permits, c) <br />provided the City with a revised site plan in accordance with improvements <br />approved by the City Counci. No Certificate of Occupancy for the Structure will <br />be issued until the Required Improvements, or a financial surety for same, are <br />accepted by the City. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required <br />Improvements shall be constructed and completed before October 1, 2005. <br /> <br />RECOGNITION OF LOCATION. The Permittee agrees to recognize the City <br />of Ramsey as the City of location on all of its forms of advertising and business <br />correspondence whenever reasonably prudent to do so. <br /> <br />INSPECTION FEES. The Permittee shall be responsible for all inspection costs <br />incurred by the City related to the installation of the Required Improvements. The <br />Permittee shall make a cash deposit into the appropriate escrow account of the <br />City and the City shall have the authority to draw upon these funds for the <br />purpose of compensating for inspection services. The amount of the deposit shall <br />be equal to five percent (5%) of the estimated cost of the Required Improvements, <br />which equates to One Thousand Two Hundred Sixty Dollars and no Cents <br />($1,260). This escrow amount shall provide surety for the cost of constructing <br />storm sewer and parking lot improvements, Upon completion of the required <br />hnprovements ro the satisfaction of the City, any surplus balance remaining in the <br />City's escrow account shall be refunded to the Permittee. <br /> <br />FINANCIAL ASSISTANCE. The City shall be responsible to provide the <br />financial' assistance listed in Section 2.2 of the Development Agreement between <br />the parties hereto dated The payment fbr the Site Improvements shall <br />be made at the time a Certificate of Occupancy for the Development Property is <br />issued. These payments will be made to Permittee only if all property taxes, City <br />fees and charges on the property are current. <br /> <br />-302- <br /> <br /> <br />
