Councilmember Kurak inquired where Sunwood Drive will continue in relation to this building. <br /> <br />Assistant Colmnunity Development Director Trudgeon replied Sunwood Drive will be on the <br />north of this building. <br /> <br />Councilmember Elvig questioned if compliance of signage in the new district should be <br />addressed at this time. <br /> <br />Assistant Community Development Director Tmdgeon replied staff has not looked at compliance <br />of the signage directly. The TC district does have special signage requirements. One argument <br />is that the signage is grandfathered in, and the applicant is not proposing any changes in the <br />signage. Staff is willing to entertain any thoughts of the Council. <br /> <br />Councilmember Elvig commented they might not need to address the si~age at this time, <br />however, as Town Center is built they may want to look at a more compliant signage <br />relationship. Pie noted a big illuminated sign would start to look odd as everything starts to quiet <br />down. He is satisfied with what is there at this time, and the signage can be looked at a future <br />time. <br /> <br />Motion by Councilmember Elvig, second by Councihnember Kurak, to appro,{e the proposed site <br />plan for M&W Holding Company contingent upon compliance with City Staff Review Letter <br />dated July 30, 2004, the Applicant entering into a Development Pemfit with the City, the <br />Applicant installing the pond outlet structure per the approved original site plan and restoring the <br />area, the Applicant enlarging the stormwater drainage pond to the approved original site plan <br />contours as necessary and establish vegetative ~'ound cover, and the Applicant repairing the <br />washouts on the south slope of the pond and establish vegetative ground cover to help hold the <br />soils in place. <br /> <br />Further Discussion: Councilmember Kurak inquired if the grandfather status is taken away when <br />an addition is added to a building. Assistant Community Development Director Trudgeon <br />· replied if a building is being added onto and meets cun'ent codes it does not remove grandfather <br />rights, h~ this case if the applicant was proposing to change the sign he would need to comply, <br />but he is not proposing anything with the sign. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Kurak, Cook, Stronmqen, <br />and Zimmerman. Voting No: None. Absent: Councilmember Pearson. <br /> <br />Case #7: Nuisances Affecting Public Peace <br /> <br />Police Chief Way advised staff recommends adoption of the new Section 5.08 "Public Nuisance" <br />expanded as it relates to public peace. <br /> <br />Motion by Councihnember Cook, seconded by Councihnember Elvig, to adopt Ordinance #04- <br />34 Adding the new Section 5.08, called "Public Nuisance". <br /> <br />-62- <br /> <br />City Council/August 24, 2004 <br /> Page 10 of 25 <br /> <br /> <br />
