Community Development Director Frolik indicated park dedication will be a combination of land and cash. There will be 1.01 acre land dedication, cash payment Of $1,034., and a private easement to be drafted and recorded by the Applicant to allow for appropriate ingress and egress Ii'om the park land to Outlot A, which the applicant will retain ownership of. She advised '~he City approved a 90-day moratorium affecting the subdivision of lots within the rural developing district that became effective in July. The subject property is included in the recently adopted moratorium. However, due to the fact that the Planning Commission approved the sketch plan in March and staff and the applicant continued to work on the plat to resolve park dedication terrns, it seems appropriate to continue with approval of the final plat. Mayor Gamec inquired about the easement around Trott Brook. Community Development Director Frolik replied an easement has not been taken on the south side of Trott Brook at this point in time. Eliot Schaeffer, applicant, explained from what he recalls it was .a matter of topography on the south side o l' Trott Brook, which was not as accommodating to a park or trail system as the north side is. Community Development Director Frolik explained the north area is rnore conducive'to a trail. It is anticipated at some point in the future Mr. Schaeffer may re-subdivide and there will be more park dedication on the south side. Councihnember Strommen noted the thought was to preserve the natural aspects of the con'idor. From that perspective she does not understand why they would not want an easement there for the purpose o f maintaining that natural corridor. Councihnember Elvig concurred. He indicated he agrees with Mr. Schaeffer about the topography, but there may be funds set up that could be used to dedicate the land for a corridor. He suggested this be explored to see if it is something Mr. Schaeffer would be willing to do. Councilmelnber Cook explained there could'be an agreernent that the property owner can retain ownership without using that land. This could be done separate of the site plan approval, as the City wo'uld not need to retain ownership of the land. Councihnember Strommen indicated Mr. Schaeffer might want to sell an. easement to the City. Councilmember Kurak noted there is park dedication on the west side of the property. It may be wise fi),' the City to wait until there is further subdivision at a later time, and to then capture land as at pal'k.
