Community Development Director Frolik suggested the approval could be contingent on staff <br />and the applicant resolving the preservation of the missing link in the ~eenway corridor. <br /> <br />CouncilmemlSer Kurak indicated she does not know that this needs to be done at this time, as no <br />one is using the land at .~his time. At the time Mr. Schaeffer subdivides in the future it would <br />likely be required, and would probably not require payment. <br /> <br />Councihnember Elvig commented the area where the park is dedicated is good, but he is not as <br />excited about a park on the south side. He stressed the need to get the ~'eenway co~xidor <br />connected on the south side. <br /> <br />Mayor Garnet commented it will likely be quite some time before that parcel is developed. He <br />would thi~c it would be beneficial for Mr. Schaeffer to resolve this at this time. The City has <br />tried to maintain that whole corridor, and acquiring it at a later time would be more difficult. <br /> <br />Mr. Schaeffer stated he will be looking at re-subdividing five to ten years in the future, and the <br />City will be looking for more park dedication at that time. <br /> <br />Councilmernber Strolnmen stated this issue should be resolved as soon as t5ossible. The <br />opportunity is here now, and they have the funds now. She inquired if there is a way to give Mr. <br />Schaeffer drectit to bank for the future. <br /> <br />Public Works Director Kapler indicated Mr. Schaeffer should be able to be credited for park <br />dedication at a future time. He advised from staff's standpoint, this ~eenway corridor is big and <br />there is funding in place. They should seize the opportunity if they can, and if they can <br />accommodate Mr. Schaeffer by putting a future credit in place. <br /> <br />City Attorney Goodrich advised there is precedent for allowing a credit in this type o£situation. <br /> <br />Councihnernber Kurak questioned if the land would be public property for people to walk on and <br />enjoy if it were to be taken as park dedication. <br /> <br />Public Works Director Kapler replied he believes there are different ways to identify the land, <br />and a conservation easement would be one option. <br /> <br />Councilmember Cook explained with a conservation easement the property owner has the right <br />to use the property, but not to change the way the property looks at this time. This would be <br />preferential to purchasing the easement, as it is really plalmed on for greenspace. <br /> <br />Councih-nember Kurak questioned if Mr. Schaeffer's ability to utilize park dedication fees would <br />be taken away. <br /> <br />City Attorney Goodrich replied this could all be addressed in the negotiations. <br /> <br />-68- <br /> <br />City Council/August 24, 2004 <br /> Page 16 of 25 <br /> <br /> <br />
