Board Member introduced the following resolution and moved for its adoption: RESOLUTION #04-09- RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT A THREE SEASON PORCH ADDITION WITHIN THE SETBACK FROM THE ORDINARY HIGH WATER MARK OF ROGERS LAKE AND DECLARING TERMS OF SAME WHEREAS, Carole Walsh (Permittee) has properly applied for a variance from Section 9.21.04 o~' the Ramsey City Code to construct a three-season porch addition within the established setback of the Ordinary High Water mark of Rogers Lake on the property generally known as 4849 179ri' Lane NW and legally described as follows: (A) That part of the north half of the northeast quarter of section 1, township 32, range 25, Anoka County, Minnesota, described as follows: Starting from the northeast corner of said section 1; thence sOuth on east line of said section l a distance of 842.16 feet to center line of public road, thence south 82 ½ degrees west 403.6 feet to actual place of beginning; thence north and parallel with the said east line of section 1 for a distance of 597 feet; thence west and parallel with north line of said section I a distance of 150 feet; thence, south and parallel with said east line of section 1 a distance of 616.7 feet to said center line of public road; thence north 82 ½ degrees east 151.4 feet to place of beginning, also (b) That part of the northeast quarter of the northeast quarter of Section 1, Toxvnship 32, Range 25, Anoka County, Minnesota described as follows: Begi~ming at the northeast comer of said northeast quarter of the northeast quarter; thence south on the east line thereof 442.16 feet to a point 400 feet north of the intersection of said east line with the center line of town road; thence west at right angles 300 feet; thence south at right angles 439.5 feet to centertine of said town road; thence south 82 ½ degrees west on said center line of town road 100.9 feet; thence north and parallel with said east line of: northeast quarter of the northeast quarter 894.84 feet, to north line of said northeast quarter of the northeast quarter; thence east 400 feet to place of beginning, excepting ti'om tract (b) that part described as follows: beginning at the northeast comer ol' said northeast quarter of northeast quarter of section 1, township 32, range 25; thence south along the east line of said northeast quarter of northeast quarter 442.16 feet; thence west at right angels a distance of 300 feet; thence north and parallel with the east line of the northeast quarter of the northeast quarter 442.16 feet more or less to the north line of section I; thence east along the north line thereof to the point of beginning, also (c) That part ol'~ the north half of the northeast quarter of Section 1, Toxvnship Range 25, Anoka County, Minnesota described as follows: Starting from the northeast corner of said section 1; thence south on the east line of said section l a distance of 842.16 feet'to the center tine of public road; thence south 82 ½ degrees west, on the center line of public road, to a point that is 400 feet westerly of the east line when measured at right angles, this being the actual place of beginning; thence north and parallel with the said east line of section 1 for a distance of 597 feet; thence 13
