Hard surfaced (bituminous or concrete) driveways are a <br /> requirernent for each lot in the Plat. Said improvement shaiI be instatIed by the building <br /> pen:nit applicant or the homeowner at the time the Certificate of Occupancy is issued or as <br /> soon thereafter as possible, weather permitting. In the event this improvement is not timely <br /> installed on a lot, the DEVELOPER and/or the DEVELOPER'S assign(s), ab~ee that the <br /> CITY' may install said improvement on tile lot and specially assess the cost therefore against <br /> the lot. The DEVELOPER hereby waives all rights to a public hearing and other statutory <br /> ~ghts or City Charter rights granted a property owner relating to special assessments, <br /> including the right to appeal ~he special assessment for installation of the hard surfaced <br /> driveway. In addition, the DEVELOPER gq'ants the CITY a license to enter on each lot of <br /> the Plat in order to insta[t the improvement described in this para,apb if the same has not <br /> been previously constructed. <br /> <br />Street Cleaning. After the street surfacing is installed, the DEVELOPER shall clear any <br />soil, earth, or debris from the streets within the Plat resu[ting from any construction within <br />the Plat by the DEVELOPER or its successors and assig-ns. From time to time, the CITY <br />may remove accumulations of soil, earth and 'debris from the streets resulting from the <br />construction of the Plat. It shall be the DEVELOPER'S responsibility to pay the costs <br />associated .with this necessa7 street cleaning. Invoices from the CITY to the <br />DEVELOPER for such costs shall be paid within filkeen (15) days of the date of invoice. <br /> <br />-30- <br /> <br /> SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits: No building permit for any lot in the <br />Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br />structure; (b) a Certificate of Survey, including that survey information required by the <br />CITY has been supplied to the City Building Official., including verification that the building <br />elevation are at least two (2) feet above the 100 year flood elevation; (c) all the financial <br />guarantees required by the CITY have been satisfied; and (id) the City has been provided <br />with a copy of the Lower Rurn River Water Management Permit. The CITY reserves the <br />fight to suspend all building activities upon the CITY being notified by an outside agency <br />tha~ the appropriate permit(s) was not obtained fi'om the applicable agency. Approval of the <br />building tbundation requires a ce~q. ificate of elevation sigmed bv a licensed (State of <br />Minnesota). professional land surveyor, veri~'ing that the elevation compiles with the <br />approved grading plan for the Plat.
