tenths (342.6) feet; thence to the right, deflection angle <br />of Eighty-six degrees, Twenty-four minutes (86o24'), for a <br />distance of Three Hundred Twenty-three and Seven tenths <br />(323.7) feet, more or less, to the Southwesterly (SW'ly) line <br />of said U. S. Highway No. 10; thence Southeasterly (SE'ly), <br />Northeasterly (NE'ly) and again Southeasterly (SE'ly) along <br />the Southwesterly '(SW'ly) line of said U. S. Highway No. 10 <br />~o the point of beginning; and being a part of Lot Nine (9), <br />Auditor's Subdivision No. 28. <br />and also including that portion of the adjacent Mississippi <br />River bed for which a permit is obtained from the S'tate of <br />Minnesota: <br /> <br />the following uses: <br /> <br />1. To clear the surface of any trees or other materials and to <br />excavate, dredge, mine and remove from said premises sand, gravel, <br />rock, stone and fill and any other material desired to be removed <br />by the lessee. <br /> <br />2. To operate washing, sorting, drying and crushing facilities and <br />machines and any items incidental thereto to process the items <br />so excavated, dredged, mined, removed or processed. <br /> <br />3. To carry on any other operations necessary~or incidental to the <br />a b ov.e. <br /> <br />This Special Use Permit is conditioned upon the following: <br /> <br />A. The above operation may be carried, on only between the hours <br />of 7:00 A.M. and 7:00 P.M. and only from Monday through Friday <br />inclusive. ~/ <br /> <br />B. Rivlyn Avenue may not be used as an access route to or from <br /> the operation. <br /> <br />C. The road near the Diickenson property on Highway 10, near the <br />Piano Shop, may be used for access until July 1, 1970 and shall <br />be treated to adequately control dust thereon. <br /> <br />D. By July 1, 1970 an access roadway on the above listed pr°petty, <br />for future usage, shall be constructed and adequate dust control <br />shall be maintained thereon so there will be no nuisance to the <br />neighboring properties. <br /> <br /> E. A buffer zone of trees shall be maintained between the above <br /> operation and the adjoining developed properties upstream and <br /> downstream. <br /> <br />This permit is issued to facilitate the construction of a marina on the <br /> <br />property so excavated, except the river bed, (but excavation under permit <br /> <br />from the State of Minnesota in the approved area of the Mississippi <br /> <br />River bed shall oe allowed), and except the property adjoining State <br /> <br />Trunk Highway Number 10, which property so adjoining State Trun~~' <br />Highway Number 10 may be used for other purposes. <br /> <br /> <br />
