Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 8:59 <br />p.m. <br /> <br />Assistant Community Development Director Trudgeon advised he would suggest that the <br />Commission recommend approval of this preliminary plat contingent on either the applicant <br />being able to get an access to line up with 147th Avenue, or platting the right-of-way to 148th <br />Avenue. Staff will then be able to continue dialogue, with the county. <br /> <br />Chairperson Nixt questioned how that would solve the problem with the parcel on the comer. <br /> <br />Assistant Community Development Director Trudgeon replied it does not. <br /> <br />Commissioner Brauer stated he could not approve access off of 148th Avenue that would mn <br />through the neighborhood. <br /> <br />Chairperson Nixt indicated there should not be access through the residential neighborhood. He <br />commented it would be preferred that the access line up with 147th Avenue, however, since that <br />will nol be allowed, the only logical access would be as a right-in/right-out at 148th Avenue <br />where it is proposed to line it up. He indicated he does not think they need the right-of-way if <br />] 48th Avenue ends in a cul-de-sac and there is no ingress or egress to this site from the <br />neighborhood. <br /> <br />Commissioner Brauer suggested the Comlnission state that they do not want the access through <br />the residential neighborhood and that the Commission approve the plat with the applicant to <br />work out an access with the county. It should be stated that the Commission is in agreement <br />with thc applicant regarding the access at 147th Avenue. <br /> <br />Mt'. Schlnidt reviewed a letter from the county dated February 16, 1996 recommending that the <br />access at 147th Avenue remain. He stated there is already access at 147th Avenue on the west, <br />and he does not think the county has wiggle room to take the access away from this piece, <br />coupled with the I ½ acre piece. He thinks this letter dictates to the county that they will have to <br />approve this. It will probably take pressure from county commissioners, but he thinks he can get <br />that. H c is comfortable with the Commission approving this with him working with the county. <br />He docs not want to run traffic through the residential neighborhood. He suggested that the <br />Commission recommend an outlet be created to create access to the parcel to the south. He <br />explained hc can use that for leverage with the county. He noted the other issue is that, staff has <br />discussed ~naking a cul-de-sac where 148th Avenue comes into his property. This would impact <br />setbacks for him substantially and he would lose up to 18 storage units. This is a substantial <br />requirement being imposed on the property. He is willing to drop his privacy fences back about <br />30 feet to allow the plow to drop the snow on the boulevard, which is what is cmTently done. <br /> <br />Chairperson Nixt suggested the possibility of a setback variance. This would provide the <br />permanent surface and the applicant would have a variance for a few units so as not to lose <br />revenue, lqc indicated staff can work this issue out to require the minimum cul-de-sac necessary. <br /> <br />Planning Commission/August 5, 2004 <br /> Page 16 of 40 <br /> <br /> <br />
