Councilmember Kurak inquired where Sunwood Drive will continue in relation to this building.

Assistant Community Development Director Trudgeon replied Sunwood Drive will be on the
north of this building.

Councilmember Elvig questioned if compliance of slgnage in the new district should be
addressed at this time.

Assistant Community Development Director Trudgeon replied staff has not looked at compliance
of the signage directly. The TC district does have special signage requirements. One argument
is that the signage is grandfathered in, and the applicant is not proposing any changes in the
signage. Staff is willing to entertain any thoughts of the Council.

Councilmember Elvig commented they might not need to address the signage at this time,
however, as Town Center is built they may want to look at a more compliant signage
relationship. He noted a big illuminated sign would start to look odd as everything starts to quiet
down. He is satisfied with what is there at this time, and the signage can be looked at a future
tIme.

Motion by Councilmember Elvig, second by Councilmember Kurak, to approve the proposed
site plan for M&W Holding Company contingent upon compliance with City Staff Review Letter
dated July 30, 2004, the Applicant entering into a Development Pennit with the City, the
Applicant installing the pond outlet stmcture per the approved original site plan and restOllng the
area, the Applicant enlarging the stonnwater drainage pond to the approved original site plan
contours as necessary and establish vegetative ground cover, and the Applicant repail1ng the
washouts on the south slope of the pond and establish vegetative ground cover to help hold the
soils in place.

Further Discussion: Councilmember Kurak inquired if the grandfather status is taken away when
an addition is added to a building. Assistant Community Development Director Trudgeon
replied if a building is being added onto and meets current codes it does not remove grandfather
lights. In this case if the applicant was proposing to change the sign he would need to comply,
but he is not proposing anything with the sign.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Kurak, Cook, Strommen,
and Zimmennan. Voting No: None. Absent: Councilmember Pearson.

Case #7:

Nuisances Affecting Public Peace

Police Chief Way advised staff recommends adoption of the new Section 5.08 "Public Nuisance"
expanded as it relates to public peace.

Motion by Councilmember Cook. seconded by Councilmember Elvig, to adopt Ordinance #04-
34 Adding the ne,v Section 5.08, called "Public Nuisance".

City Council!
