ESOLUTION ADOPTING FINDINGS OF ·FACT #0 RELATING TO A Pd~iQUEST .FOR A VARIANCE TO THE TWENTY (20) FOOT PAVEMENT SETBACK FROM PUBLIC STREET RIGHT-OF-WAY. WIIEREAS, Daniel Druk, hereinafter referred to as "Applicant," has properly applied for a variance fi'om Section 9.20.22 regarding minimum pavement setbacks from public street right- o~'-way in the B-2 Business District on the property generally known as 9535 Hwy. #i0 and legally described as follows: Lot 2, Block [, Cowles Addition, Anoka County, Minnesota. (the %ubject Property") NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CiTY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the Ramsey City Code on October 7, 2004, and that said public hearing was properly advertised, and that the minutes of said public hearing are hereby incorporated as a part of these findings by re~'erence. 2. That the Subject Property is zoned B-2 Highway Business and the Portion of the Subject Property leased by the Applicant for auto sales is approximately 6,000 square feet. 3. ri'hat properties to the east and west are zoned B-2 Highway Business. 4. That the property to the north is raiiroad right'of way. 5. That the property on the south side of Highway #10 is zoned Mixed Use - Planned Unit l)eve[opment. That auto sales is a permitted use in tixe B-2 Highway Business District provided the driveway, customer/employee parking and vehicle display areas are paved and the perimeter of' the pavement is finished with continuous concrete curbing. 7. That section 9.20.22 (B-2 Highway Bttsiness District) requires a twenty (20) foot setback between any pavement and public street right-of-way. 7
