April 10, 2017 I Volume 11 I Issue 7 Zoning Bulletin <br />Zoning News from Around the Nation <br />KENTUCKY <br />The Kentucky House of Representatives has passed HB 72, which is aimed at <br />discouraging "frivolous" appeals of zoning decisions. Under the bill, a plaintiff <br />that challenges a zoning decision and loses in circuit court, would be unable to <br />appeal the case to the Kentucky Court of Appeals without posting an appeal bond <br />that could be as high as $100,000 to $250,000. The bill now heads to the state <br />Senate for consideration. <br />Source: Insider Louisville; htty://insiderlouisville.conz <br />NEW YORK <br />The City of Buffalo's Common Council is considering legislation aimed at <br />creating more affordable housing. No specific inclusionary zoning measure has <br />been proposed, but any such legislation would reportedly "require the owners of <br />new multiple -unit developments —especially those benefiting from public financ- <br />ing or tax breaks —to set aside a portion of their units as affordable housing or <br />below market rate." <br />Source: The Buffalo News; httvs://buffalouews.coin <br />VIRGINIA <br />The House of Delegates has passed House Bill 1766, which would allow <br />"certain electric utility substations and other facilities to sidestep local planning <br />and zoning approval." The bill "applies only to 138 kilovolt transmission lines <br />that are almost exclusively used by Appalachian Power in their Southwestern Vir- <br />ginia service area. The bill would <br />"vest building and permit applications for zoning, environmental and land -use <br />regulations."
