Councilmember Zimmerman commented this is a good use of the City Stormwater Utility Fund. <br />If this amount was added to this local problem it would really be a burden on the homeowners in <br />that area. <br /> <br />Assistant Public Works Director Olson indicated the Shumway case discussed earlier is another <br />example of the reason for the Stormwater Utility Fund. There is a need to get drainage onto <br />some of these streets and to maintain a good road system. <br /> <br />Motion by Councilmember Elvig, second by Councilmember Cook, to approve Resolution #04- <br />08-218 awarding Project #04-24 Helium Street/169th Avenue Drainage project to Penn <br />Contracting, Inc. in the amount of $66,240. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Kurak, Strommen, <br />and Zimmerman. Voting No: None. Absent: CouncilmemberPearson. <br /> <br />Case #8: <br /> <br />Request for Final Plat Review of Alpine Acres 3rd Addition; Case of Oak <br />Creek Builders <br /> <br />Community Development Director Frolik indicated Oak Creek Builders has applied for final plat <br />approval of Alpine Acres 3rd Addition. This final plat conforms to the preliminary plat. Park <br />dedication, trail fees, and storm water management fees for the third phase will consist of a cash <br />payment. She noted the City recently established an ordinance adopting MN State Building Code <br />Amendment 1306. A portion of the amendment requires residential dwelling structures over <br />8,500 square feet in size to install a fire sprinkler suppression system. In the case of Alpine <br />Acres 3''~ Addition, a significant portion of the streets and infrastructure is already constructed <br />within the third addition. In order for Alpine Acres 3rd Addition to comply with 1306, the <br />existing streets will have to be removed, infrastructure resized, and streets reconstructed. Staff <br />does not see the advantage of disturbing existing streets and infrastructure; therefore, in <br />situations where a residential structure is located adjacent to existing streets and infrastructure <br />that was installed prior to July 23, 2004, staff suggests that the City waive the amended 1306 <br />compliance requirement. She advised staff recommends final plat approval of Alpine Acres 3~d <br />Addition, waiving the requirement of the fire suppression equipment, but would like to reserve <br />the right to verify the trail construction credit due in item #19 of the development agreement with <br />the Engineering Department. <br /> <br />Councihnember Zimmerman asked if a future homeowner could put in the fire suppression by <br />themselves. <br /> <br />Public Works Director Kapler replied every home could do that. The issue was with the <br />infi'astructurc in the street; the stub size is too small and staff thought it would be an undue <br />burden to tear up the street and redo the water.
