Public Works Director Olson replied there are alternate ways, but they are more expensive. <br /> <br />Counci Imelnber Strommen questioned if staff is aware of any other situations with developments <br />with the majority of the infrastructure in. <br /> <br />Public Works Director Kapler replied the other development that is practically intact is Town <br />Center Gardens. The newest phase of Town Centex' Gardens will be totally required to conform <br />to the 1306 amendment. <br /> <br />Counci hnember Kurak inquired about item #19 in the development agreement. <br /> <br />Comlnunity Development Director Frolik replied that condition addresses an amendment to the <br />original development agreement with respect to the construction of the trail and the credit to be <br />reserved back. Staff reserves the right to verify that credit with the Engineering Department. <br /> <br />Assistant Public Works Director Olson explained there was originally in the development <br />agreement about 2,300 lineal feet where the City was going to pay outside the limits of the plat. <br />When the design was done they found there was more than originally anticipated outside the plat <br />and eligible for credit against the trail easement the developer would have to pay. The City <br />agreed to pay an additional $5,000 for that additional trail work. He does not see that was taken <br />into consideration, and the amount reflected could be $5,000 less. <br /> <br />Counciln~ember Elvig inquired about the ordinance that was previously revised increasing the <br />arterial road setback. He noted they changed the ordinance for the area of Town Center to be <br />sure the buildings are pulled to the front, however, they had looked at other corridors to allow <br />more room for buffer and vegetation. <br /> <br />Community Development Director Frolik indicated this topic will be placed on a worksession <br />agenda. <br /> <br />Mayor Gamec stated there is also a need to look at the maintenance of some of these areas. He <br />conqmented crews have been weeding on the east side of Highway 47, but the west side looks <br />like a weed patch. <br /> <br />Motion by Councilmember Kurak, second by Councilmember Cook, to adopt Resolution #04-08- <br />219 approving the final plat of Alpine Acres 3rd Addition contingent upon compliance ~vith City <br />Staff Review Letter dated July 23, 2004 and the Developer entering into a Development <br />Agreement with the City, waiving the requirement of the fire suppression equipment, and <br />reserving thc right to verify the trail construction credit due in item #19 of the development <br />agreement with the Engineering Department. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Cook, Elvig, Strommen, <br />and Zimmerman. Voting No: None.
