COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Public Hearing to Vacate a Portion of a Drainage and Utility Easement on <br />Lot 2, Block 1, Hauser Addition (Wiser Choice Liquor); Case of M & W <br />Holding LLC <br /> <br />Mayor Gamec closed the regular portion of the City Council meeting at 7:05 p.m. in order to <br />conduct a public hearing. <br /> <br />Public Hearing <br /> <br />Mayor Gamec called the public hearing to order at 7:05 p.m. <br /> <br />Presentation <br /> <br />Assistant Community Development Director Trudgeon explained Lot 2, Block 1, Hauser <br />Addition currently has standard drainage and utility easements around the perimeter of the lot. <br />The parcel is located at 14590 Armstrong Boulevard and is presently occupied by Wiser Choice <br />Liquor Store. M&W Holding LLC is requesting site plan approval for an expansion of the liquor <br />store that would encroach in the drainage and utility easement along the southern property line. <br />The applicant has asked that the drainage and utility easement along the southern property line be <br />vacated in order to allow for the expansion. The expansion will contain additional cooler space <br />and display area. Since there is a standard 10-foot drainage and utility easement along the <br />southern lot line, the easement will need to be vacated to allow for the expansion. There are no <br />utilities located in the present easement and drainage will be reviewed as part of the site plan <br />approval, tte advised staff recommends that the City Council conduct the public hearing and <br />introduce the ordinance vacating the drainage and utility easement along the southern property <br />line of Lot 2, Block 2, Hauser Addition. <br /> <br />Citizen In put <br /> <br />T]lcYe was norle. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Elvig, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Kurak, Strommen, <br />and Zimmerman. Voting No: None.
