· Councilmember Zimmerman introduced the following resolution and moved for its <br /> adoption: <br /> RESOLUTION #94-02-040 <br /> <br />A RES~OLUTION ADOPTING FINDINGS OF FACT #0354 RELATING TO <br />CATHY !GUSTAFSON'S REQUEST FOR A CONDITIONAL USE PERMIT.TO <br /> MAINTAIN AN ACCESSORY APARTMENT IN A SINGLE FAMILY <br /> DWELLING UNIT IN THE R-1 RURAL RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Cathy Gustafson, hereinafter referred to as "Applicant", have properly <br />applied for a~Condidonal Use Permit to maintain an accessory apartment in a single fam~y dwelling <br />unit in the R-1 Rural Residential District on the property generally known as 15823 Nowthen <br />Blvd. N.W. and legally described as follows: <br /> <br />That'part of the Southwest Quarter of the Southwest Quarter of Section 14, Township 32, <br />Range 25, Anoka County Minnesota described as follows: Cornmencing at the Southeast <br />comer of said Southwest Quarter of the Southwest Quarter wkich point is the intersection <br />of the South line of said Section 14 with the centerline of County State Aid Highway No. <br />5; Thence North 0 degrees 36 minutes 25 seconds West along said Centerline a distance of <br />224.10 feet; thence Northwesterly on a tangential curve to the left having a radius of <br />442.92 feet and having a delta angle of 37 degrees 57 minutes 15 seconds for a distance of <br />293~40 feet; Thence North 38 degrees 33 minutes 40 seconds West along said centeriine <br />and tangent to said curve a distance of 447.0 feet to the actual point of beginning of the tract <br />of land to be hereby described; Thence continuing North 38 degrees 33 minutes 40 seconds <br />Westalong said centerline a distance of 290.90 feet; Thence North 69 degrees 40 minutes <br />20 seconds East to its intersection with the East line of said Southwest Quarter of the <br />Southwest Quarter; Thence Southerly along said East line to its intersection with a line <br />having a bearing of North 89 degrees 42 minutes 50 seconds East and drawn from the <br />actual point of beginning; Thence South 89 degrees 42 mutes 50 seconds West a distance <br />of 360 feet, more or less, to the actual point of beginning (for the purpose of this <br />description, the South line of said Section 14 is assumed to have a bearing of East and <br />West.) <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY ~THE CITY COUNCI2L OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public' <br />hear!Ll.' ~g pursuant lo Section 9.03.04 of the l~amsey City Code on February 1, 1994, and <br />that thepublic hearing was properly advertised and that the m~nutes of said public hearing <br />are hereby incorporated by reference. <br /> <br />2. That the subject property is approximately four (4) acres in size. <br /> <br />3. That the subject property is zoned R-1 Rural Residential. <br /> <br />That the surrounding properties are also zoned R-1 Rural Residential. <br /> <br />That according to R~msey City Code Section 9.20.11, the R-I Rural Resident/al District is <br />intended for single family dwelling units. <br /> <br />That the City. Buildin[ Official has indicated that the main dwelling structure was <br />constructed in about 1964 and an addition to the dwelling was constructed in about 1974. <br /> <br />That the Applicant currently resides in the addition and the Applicant's daughter and family <br />reside in the main living quarters. <br /> <br />That the Applicant has submitted a written statement indicating that a conditional use permit <br />should not be necessary because the main living quarters and accessory apartment are <br />occupi~l by family and the un/ts are non-income producing, and the two units are serviced <br />by the same septic system and well. <br /> <br /> <br />
