Staff, <br /> <br />That the Applicant has stated that the accessory apartment has been utilized as such ever <br />since it was constructed ia.the 1970's and the Applicant continued this use when takSng <br />ownership of the dwelling unit in 1991. <br /> <br />That City Staff has determined that the homeowner responsible for constructing the <br />acces, sory apartment .in the 197frs never properly obtained a conditional use permit in <br />acco~ce with City Code and therefore the accessory apartment is considered illegal non- <br />conforming. <br /> <br />Thatlthe main living quarters and accessory apartment were damaged by rue in 1993 and <br />upom inspection by City Staff, the Applicant was informed that a Conditional use permit <br />mustibe obtained to bring the accessory apartment into compliance with City Code. <br /> <br />That the Applicant has submitted a petition signed by four (4) neighboring residents <br />indicating no objection to the added living quarters. <br /> <br />That there are other similar permitted conditional uses in the single family district. <br /> <br />That the proposed use will not adversely impact traffic in the arem <br /> <br />That the proposed use will not be dangerous or detrimental to persons residing or working <br />in the vicinity. <br /> <br />That the proposed use will not substantially or adversely impair the use, enjoyment or <br />market value of surrounding properties. <br /> <br />That .the proposed use will be maintained in order to be harmonious, in appearance with the <br />existing and intended character of the R- I Rural Residential District. <br /> <br />That the proposed use will be adequately sewed by essential public services. <br /> <br />That the proposed use will not create excessive additional requirements at public cost for <br />public-facilities and services. -'" <br /> <br />The motion for the adoption of the foregOing resolution was duly seconded by Councilmember <br />Beyer and upon vote being taken thereon, the following voted ia favor thereof: <br /> <br />Mayor James Gilbertson <br />Count!member Gerald Z~mmerman <br />Coun~lmember Sheila Beyer <br />Counc.ilmember Kenneth Peterson <br /> <br />and the following voted against the same: <br /> <br />Councilmember Glen Hardin <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br /> <br />
