acceptable. One of the conditions of Anoka County's approval is that the corner property <br />also utilizes this access, should it redevelop in the future. The preliminary plat shows an <br />outlot at this location; an additional legal agreement will need to be drafted to guarantee <br />access to this corner property. <br /> <br />The most current lanidscaping plan is still significantly deficient in terms of shrubs, most <br />notably in both the bufferyards to the north and east. An additional 158' shrubs are <br />required to meet City Code requirements. At the 'July 1st meeting the Planning <br />Commission recommended a privacy fence between the proposed development and the <br />residential properties to the south, east, and north. The site plan currently shows an 8-foot <br />chain link fence. <br /> <br />The proposed site plan received its WMO permit approval on September 16, 2004. WMO <br />approval contained several conditions, including the addition of additional 'dead storage' <br />on the Subject Property, and verification that the lowest floor elevations of adjacent <br />homes in Regency Pond are 2 feet above the 100-year peak flood elevation. Revised <br />grading and drainage plans and calculations were submitted on October 6, 2004; the <br />WMO engineer will need' tO review'these revised plans to ensure they comply with the <br />WMO permit approval. <br /> <br />Recommendation: <br /> <br />The Planning Commission recommended approval of the proposed site plan at their July <br />12, 2004 meeting, contingent on approval of the subdivision request. Several significant <br />issues remain unresolved with the site plan. The site plan also continues to show an 8- <br />foot chain link fence surrounding the Subject Property. Staff feels strongly that a privacy <br />fence should be constructed, per the Planning Commission's recommendation. The site <br />plan is also showing a 30-foot bufferyard along the northern property line, which does not <br />meet the 60-foot width required by City Code.
