AMENDMENT TO THE TC-2 ZONING DISTRICT REGARDING ALLOWING <br />ACCESSORY GAS OPERATIONS, <br /> CASE OF RAMDANCE LLC <br /> By: Patrick Trudgeon, AICP, <br /> Assistant Community Development Director <br /> <br />Background: <br /> <br />Ramdance LLC has submitted a site plan to construct their first phase of commercial buildings in <br />the Ramsey Town Center. Part of the first phase will consist of a ~ocery stores with an <br />accessory gas operation. The property to be developed is zoned TC-2. Under the TC-2 Zoning · <br />District regulations, gas stations are not permitted. <br /> <br />The Planning Commission and City Council previously reviewed and approved a concept plan <br />for Ramdance's commercial devel0pme'nt. The concept plan showed a gas operation that was <br />accessory to the grocery store. The Planning Commission and City Council' discussed the <br />accessory gas operations during their review. It was decided that limited gas operations would <br />be acceptable as shown on the concept plan as long as the TC-2 District was amended to allow <br />for it. The concept plan was approved by the City Council on May 11, 2004 and the ordinance to <br />allow fbr limited gas operations was introduced by the City Council on July 27, 2004.. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br /> <br />City Council Minutes dated May 11, 2004 <br />City Council Minutes dated July 27, 2004 <br />Proposed Ordinance to the TC-2 Zoning District <br /> <br />Notification: <br /> <br />A public hearing on these amendments was properly notified in accordance with state statutes. <br /> <br />Observations: <br /> <br />Ramdance LLC is bringing forward the final site plans for their development at this time. As <br />part of the approval process, the City Council now has to consider the adoption of the ordinance <br />to allow for limited gas operations in the TC-2 Zoning District. <br /> <br />At the July 27, 2004 meeting, the City Council discussed the'proposed ordinance and considered <br />some changes suggested by the Developer. The discussion revolved around the percentage cap <br />on gas and convenience item sales, clarifying what is meant by fast food operations, and <br />clarifying how many gas dispensing areas ar~ allowed. There was also discussion regarding <br />special mitigation measures that need to be taken since the gas tanks will be located In a <br />wellhead protection area. Based o~ Council direction, Staff has redrafted the ordinance to allow <br />for accessory gas operations In the TC-2 Zoning District under the following conditions <br /> <br />· Gas operations are accessory to a permitted principal use. <br /> Gas and convenience item sales shall not comprise more than 25% of the gross <br /> receipts of the principal use business. <br />· Payment for sale o£ gas must be paid at the pump or inside the principal building. <br /> No accessory structures are allowed as part of the gas operations. <br /> <br /> <br />
