No more than 5% of the square footage of the principal use building may be <br />dedicated for the gas operations and convenience item sales. <br />No franchise food operations can be contained in the area designated within the <br />principal building for gas operation and convenience item sales. <br />Gas operations located in the side or rear of the principal use building. <br />Gas operations are located within 100 feet of principal use building. <br />Gas islands and canopy are architecturally harmonious and contain the same <br />exterior building materials as the principal use building. <br />Gas operations shall constitute no more than three islands with a limit of Six <br />dispensers. <br />Gas operations that are located in the City's wellhead protection area must meet <br />the following standards: <br /> a) Double walled storage tanks with corrosion protection. <br /> b) Spill protection to catch spills that may occur during delivery of <br /> products. <br /> c) Overfill protection including automatic shutoff devices, overfill <br /> alarms and ball float valves. <br /> d) Leak detection, including interstitial monitoring of the double walled <br /> tank. ~ <br /> e) Product release monitoring, including installation of ~oundwater <br /> monitoring wells and monthly monitoring of these wells will be <br /> required if a leak has been detected. <br /> f) Tank Tightness Testing on an annual basis. <br /> g) Annual reports summarizing monthly monitoring results, monthly <br /> inventory control, and tank tightness testing: <br /> <br />Staff specifically made changes in increasing the amount of goss sales allowed from 10% to <br />25%, added the word "franchise" when defining fast food operations, and clarified the language <br />defining the amount of fueling areas to allow for three islands and six dispensers. It should be <br />noted that the Staff and the Applicant have met to discuss the wellhead protection standards. <br />The standards contained in the draft ordinance are the minimum 'standards Staff feels should be <br />implemented. <br /> <br />Recommendation: <br /> <br />Staff recommends the City Council adopt the proposed ordinance. <br /> <br />City Council Action: <br /> <br />Motion to adopt Ordinance #04-10- adopting an amendment to the TC-2 Zoning District to <br />allow for accessory gas uses subject to certain performance standards. <br /> <br />Review Checklist: <br />Community Development Directo} <br />Assistant Public Works Director <br /> <br />CC:' 10/12/04 <br /> <br /> <br />
